Chapter 8.84 - DRAINAGE AND TRAFFIC IMPROVEMENTS

8.84.010 - Conditions to exercise of land use.

In addition to any other requirements imposed by this code, the requirements imposed by this chapter are conditions precedent to the exercise of any land use entitlement under this title.

8.84.020 - Drainage requirements.

Drainage facilities shall be installed under a permit issued under this code which are adequate to meet the drainage design standards and requirements set forth in this code. A permit for the installation of drainage facilities will not be issued until an application, plans and exhibits for the facilities are submitted which comply with the requirements of this code.

8.84.030 - Improvements for traffic.

A.

On or off site traffic improvements for the handling of vehicular and pedestrian traffic to maintain adequate service levels shall be installed in areas affected by the development at no expense to the town, or contractual arrangements approved by the town for such improvements shall be entered into.

B.

"Improvements" includes, but is not limited to, street paving and curbs or sidewalks, striping, signalization, traffic control devices and landscaping and shall include dedication to the town of an easement over the improved areas for such purposes in a form satisfactory to the town, sufficient for vehicular and pedestrian travel and the maintenance and policing of the improved area by the town.

C.

"Street" means a public street or way or other area open to the public for pedestrian and vehicular traffic.

D.

A person dissatisfied with the finding of the town that the installation of improvements is required may appeal the finding to the council.
