§ 8.16.030. Required.

No person shall engage in the construction or substantial remodeling of a restaurant, bakery, commissary, food establishments open to the outside air, food processing establishment, ice distribution facility, ice plant, retail dairy, roadside stand, retail food production and marketing establishment, retail sales area of a growerseller premises, public swimming pool or public water system without having a current permit to construct issued by the director; provided, however, that a retail sales area of a grower-seller premises may be constructed without a permit to construct if no other permits for the structure are required by the building inspector.

§ 8.16.040. Application—Issuance.

A. An application for a permit to construct must be submitted to the director in such form as the director may prescribe, together with two sets of plans for the new construction or remodeling and payment of the permit to construct fee established pursuant to Section 8.16.190 of this chapter.

B. Upon receiving such application, plans and payment, the director shall issue the permit only if it appears to the director, upon review of the plans, that all applicable state and county environmental health requirements will be met.

C. Where plans submitted with an application must thereafter be extensively revised and resubmitted for approval, such resubmittal shall be accompanied by payment of an additional fee equal to one-half of the initial permit to construct fee. This additional fee shall be paid each time there is such a resubmittal involving extensive revision of plans. No such additional fee shall be required where the resubmittal is for approval of minor corrections. The director shall be the sole arbiter of whether a change in the plans is an extensive revision or a minor correction.

§ 8.16.050. Term.

Subject to Section 8.16.140 of this chapter, a permit to construct shall be valid for a period commencing on the date of issuance and ending either one year thereafter or upon completion of the construction or remodeling for which it was issued, whichever period is shorter. Upon written request, the director may, for good cause shown, extend the one year term for an additional period not to exceed one year or such shorter period as may be required to complete the construction or remodeling.
