§ 5.56.010. Definitions.

As used in this chapter:

"Hold"

means and includes the holding, conducting, managing or operating of any race as defined in this section.

"Motor vehicle"

means any self-propelled vehicle.

"Motor vehicle races"

means any race, contest, competition or competitive trial of speed by and between motor vehicles as defined in this section.

"Owner"

means and includes the owner, lessee or other person legally in possession or entitled to the possession of land.

§ 5.56.020. License—Required.

No person as principal shall hold a motor vehicle race or races without first obtaining a license therefor.

§ 5.56.030. License—Application.

Any person desiring to obtain a license to hold a motor vehicle race or races shall make a written application to the sheriff therefor, stating in addition to the information required by Section 5.04.100 of this title, the following information:

A. The name, address and age of applicant;

B. The location of the track or course in which it is proposed to hold any such race or races;

C. The name of the owner of the land upon which the track or racecourse is located;

D. Whether the applicant has obtained from the owner of the land upon which it is proposed to hold or conduct such race, permission or consent for holding thereof upon his or her land;

E. On what day or days it is proposed to hold such race or races;

F. What safety precautions have been or will be taken to ensure the safety of the public;

G. Whether the applicant has, in effect, a policy of indemnity insurance, issued by a reliable insurance company licensed to carry on an insurance business in the state, sufficient to compensate spectators present at any such race held by the applicant for any injury sustained by any spectator as a result of any accident or as a result of any negligent or careless operation to any motor vehicle placed in competition at any such race or competition. Proof of the insurance policy is presented with the application.

§ 5.56.040. License—Fee.

The fee for the license required by Section 5.56.020 of this chapter is the sum of $10 per day or $100 per year, whichever is lower.

§ 5.56.050. License—Approval.

The sheriff shall approve the application unless it shall appear that the health and safety of the community would be endangered by the proposed motor vehicle race or races.
