§ 6.10.010. Purpose.

The purpose of this chapter is to provide for the responsible collection and disposal of trash, rubbish, and solid waste accumulated by passengers of tour bus operators visiting the city of Monterey Park in an effort to protect public health, safety and well-being of the city residents and visitors. This chapter is determined and declared to be a sanitary measure for the health, safety, and general welfare of the people of the city of Monterey Park.

§ 6.10.020. Definitions.

As used in this chapter:

"Limousine"

means a motor-propelled sedan vehicle of either standard or extended length, with a lawful seating capacity of not more than fourteen passengers, including the driver, and used in the transportation of passengers on a prearranged basis.

"Taxicab"

means every automobile or motor-propelled vehicle by means of which passengers are transported for hire upon any public street in the city, and not over a regular or defined route and irrespective of whether the operation extends beyond the boundary limits of the city or not.

"Tour bus"

means any motor-propelled vehicle that is used for the transportation of passengers for consideration or compensation and is subject to license for such by the Public Utilities Code, except taxicabs and limousines, and except "buses," as defined and regulated under Section 10.52.070 of this code.

"Tour bus operator"

means the owner, proprietor, and/or manager of the bus company providing the transportation service, including any agents therefor.

§ 6.10.030. Collection and disposal of trash by tour bus operator.

(a) It is the duty of any tour bus operator, and agents thereof, operating tour buses within the city to:

(1) Prevent the accumulation of solid waste in quantities that are unreasonable or detrimental to the public health or safety;

(2) Collect, or provide some mechanism for the collection of, all trash, rubbish, and solid waste from passengers upon reaching the destination for the unloading of passengers in the city of Monterey Park and before, or during, the unloading of passengers;

(3) Collect, or provide some mechanism for the collection of, all trash, rubbish, and solid waste from passengers when loading passengers prior to departure from the designated parking area for tour buses; and

(4) Dispose of all trash, rubbish and solid waste collected from tour bus passengers at some location outside the city of Monterey Park.

(b) It is unlawful for any tour bus operator to dispose of trash, rubbish, and solid waste, which is collected from passengers, either upon arrival or departure, in the city of Monterey Park.

§ 6.10.040. Signs.

The city engineer is authorized to post conspicuous signs giving notice of the requirements of Section 6.10.030 of this chapter, at all locations in the city's jurisdiction where the loading and unloading of tour bus passengers is permitted.

§ 6.10.050. Violation.

Any tour bus operator, including agents thereof, who operates a tour bus within the city and who fails, or refuses to carry out the duties imposed by this chapter, shall be guilty of an infraction or misdemeanor and punishable as set forth in Chapter 4.10 of this code.
