As used in this Chapter, "apiary" means a place where bees and their hives are kept.

As used in this Chapter, "bees" means honey-producing insects of the species apis mellifica, including the adults, eggs, larvae, pupae or other states thereof, together with such materials as are deposited into hives by bees.

As used in this Chapter, "hive" is a structure for housing bees, including a fresh water source on the same property not more than one hundred (100) feet away from the hives (not a pool, hot tub nor spa).

A. Location. Apiaries or hives shall only be located in the rear yard of any residential property and located no closer than six (6) feet from the side yard property line and no closer than ten (10) feet from the rear yard property line. All apiaries and hives must be oriented so that their entrances face a house or building on the premises.

B. Number of apiaries or hives. No more than six (6) apiaries or hives may be kept or maintained on any residential property in the R1-44 zoning district. No more than four (4) apiaries or hives may be kept or maintained on any residential property in the R1-20 zoning district. No more than two (2) apiaries or hives may be kept or maintained on any residential property in the R1-8 zoning district.

C. Height of apiaries or hives. Apiaries and hives shall be no taller than six (6) feet in height.

D. Commercial purposes. No apiaries, hives or products from them located in the City of Monte Sereno shall be used for commercial purposes.

E. Compliance with laws. Any person maintaining apiaries or hives on his/her property shall comply with all local, state and federal laws.

Any person maintaining apiaries or hives in violation of this Chapter shall be subject to the provisions of Title 5 of the Monte Sereno Municipal Code.
