1.02.010 - Definitions.¶
As used in this Code:
Administrative decision means any decision made by any official of the City pursuant to any of the provisions of this Code. Such decision may be in the form of a Notice to Correct, Notice to Abate, Notice to Comply, or any other written notice related to an alleged public nuisance or other alleged violation of this Code. Such decision shall include any denial, suspension, or revocation of a permit applied for or held.
Calendar year means the period from January 1st through December 31st of any given year.
City means the City of Montclair.
Council means the City Council of the City of Montclair.
Enforcement Officer means any employee of the City or agent for the City authorized to enforce the provisions of this Code.
Fiscal year means the period from July 1st of any given year through June 30th of the following year.
Hearing Officer means a person designated by the City Manager to determine the validity of a violation or complaint.
Legally responsible person means a natural person, heirs, executors, administrators or assigns, firm, partnership or corporation, its heirs or their successors or assigns, or the agent of any of the aforesaid, responsible for the creation, existence, commission and/or maintenance of a violation of this Code or any applicable State statute.
May. May shall be permissive.
Month means a calendar month unless otherwise expressed.
Occupant, when applied to a building or land, means and includes any person who occupies the whole or part of such building or land, whether alone or with others.
Person means any person, firm, company, corporation, partnership, association, public corporation, political subdivision, city (excepting the City of Montclair), County of San Bernardino, district in the County of San Bernardino, the State of California, or the United States of America, or any department or agency of any thereof, unless this Code expressly provides otherwise.
Personal property means money, goods, chattels, things in action, and evidences of debt.
Property means both real and personal property.
Property owner means the person(s) or entity(ies) listed on the San Bernardino County Current Equalized Assessment Roll as the owner(s) of the subject property.
Quarterly, when used to designate a period of time, means the first three calendar months of any given year or any succeeding period of three months.
Real property means lands, tenements and hereditaments.
Shall. Shall means something is mandatory.
State means the State of California.
Street means a street within the corporate limits of the City.
