5.08.010 Statutory authority.¶
This chapter is enacted pursuant to Section 19 of Article 4 of the Constitution of the State of California and as authorized by Penal Code Section 326.5. (Ord. 145 § 1, 1976)
5.08.020 Defined.¶
As used in this chapter, “bingo” means the game of chance in which prizes are awarded on the basis of designated numbers or symbols on a card which conform to numbers or symbols selected at random. (Ord. 145 § 2, 1976)
5.08.030 Eligible organizations.¶
It is lawful for bingo games allowed by this chapter to be conducted only by organizations exempted from the payment of the bank and corporation tax by Sections 23701a, 23701b, 23701d, 2370le, 23701f, 23701g and 23701l of the Revenue and Taxation Code of the state and by mobilehome park associations and senior citizen's organizations, provided that the receipts of such games are used only for charitable purposes, and so long as the organization obtains a license to conduct the games from the city clerk, and so long as the bingo game or games are conducted in accordance with this chapter and any applicable law of the state. 5.08.040 License.¶
Any organization qualified to conduct a bingo game under the provisions of this chapter shall apply for a permit to conduct such game or games during any calendar year. Such application shall be on a form prescribed by the city clerk and shall be accompanied by an annual license fee of fifty dollars. The city clerk may require such verification as may be necessary to establish the organization's status under Section 5.08.030. Upon verification of the status, the city clerk shall issue a license to the organization to conduct bingo games within the city at the times and places specified in the license and for the calendar year in which application is made.
