20.01.010 Short title.¶
The ordinance codified in this chapter may be referred to as the “Montague-Yreka Airport Rules and Regulations” and shall constitute Chapter 20.01 of the Code of the City of Montague, California. (Ord. 11-01, 2012)
20.01.020 Applicability.¶
This chapter applies equally to every user of the Montague-Yreka Airport. (Ord. 11-01, 2012)
20.01.030 Definitions.¶
“Abandoned” means an aircraft that is left sitting outside of a hangar on the Montague-Yreka Airport and/or for which no storage fees have been paid for at least three consecutive months by the owner/ operator.
“Aircraft” means a device that is used, or intended to be used, for flight in the air. It includes airplanes, helicopters and gliders, and lighter-than-air-devices such as blimps or balloons, but does not include hang gliders.
“Airport” means the Montague-Yreka Airport, its buildings and facilities, all lands owned by the city contiguous to the airport, including airspace above such land and the designated approaches thereto.
“Manager,” as used in this chapter, means the City Clerk of the City of Montague, or his/her designee.
“Person” means an individual, firm, partnership, corporation, company, association, joint-stock association, or governmental entity, and includes a trustee, receiver, assignee, or similar representative of any of them. (Ord. 11-01, 2012)
20.01.040 Responsibilities.¶
A. Management. It shall be the responsibility of the manager to fairly and impartially administer the MontagueYreka Airport rules and regulations.
B. Users. It shall be the responsibility of every user of the Montague-Yreka Airport, pilot or other, to become familiar with the Montague-Yreka Airport rules and regulations and to obey those rules and regulations. A copy will be maintained current to reflect any amendments and will be posted in the hangar. Additional copies will be provided by the city clerk to any user of the airport who requests such copy. 20.01.050 Necessity.¶
This chapter is enacted to protect the health, safety and peace, and to promote the welfare and convenience of the general public using the Montague-Yreka Airport, or affected by activities related to the airport by providing for the orderly conduct of activities on, or related to, the airport. (Ord. 11-01, 2012)
20.01.060 Aircraft storage and parking.¶
Aircraft shall only be stored or parked at places designated by the manager and such storage or parking shall be at the sole risk of the owner or operator of the aircraft, and without any responsibility of the Montague-Yreka Airport, the city, or any of its officers or employees, for any loss of, or damage to the aircraft while so stored or parked. The owner or operator of the aircraft shall be responsible for the tying-down and securing of his aircraft. He shall likewise be responsible for any liability arising from or caused by his aircraft or his activities. Transient aircraft shall only be parked in the area designated by the manager. 20.01.070 Rental agreement.¶
Each person renting space for aircraft storage at the Montague-Yreka Airport is required to execute a lease agreement with the manager of the Montague-Yreka Airport. The lease agreement shall specify, among other things, the rental rate, deposit rate, insurance requirements, and storage requirements. All leasees must abide by all of the terms and conditions of the lease agreement. (Ord. 11-01, 2012)
20.01.080 Insurance.¶
a. Each aircraft based at the Montague-Yreka Airport must have Combined Single Limit for Bodily Injury and Property Damage insurance in the amount of one million dollars, subject to a Passenger Limitation of one hundred thousand dollars per passenger seat. The coverage shall contain an endorsement which applies its coverage to the City, the members of the Montague City Council, the Montague-Yreka Airport Commission, and their officers, agents, employees, and volunteers, individually and collectively, as additional insured.
b. Proof of said insurance shall be submitted to Manager and City. The City, in its discretion, may demand that anyone leasing space at the Montague-Yreka Airport change its policies if the deductibles are deemed too high by the City's risk manager. (Ord. 13-01, 2012; Ord. 11-01, 2012)
20.01.090 Based aircrafts.¶
Any person desiring to store or base his aircraft at the Montague-Yreka Airport shall register his aircraft at the city clerk's office prior to beginning such storage or operations, and at any time that a change in ownership occurs. The use of the airport or any of its facilities in any manner shall create an obligation on the part of the user to obey all of the rules and regulations provided in this chapter. (Ord. 11-01, 2012)
20.01.100 Authority to remove vehicles and aircrafts.¶
The manager may cause to be removed from any area of the airport any vehicle or aircraft which is disabled, abandoned, parked in violation of these regulations, or which presents an operational hazard as determined by the manager to any area of the airport, at the operator's expense and without liability for damage which may result in the course of such movement. 20.01.110 Violations and enforcement.¶
A. Unless noted otherwise, the violation of any provision of this chapter shall be an infraction.
B. The city reserves the right to prohibit any person or entity from using the airport or engaging in activities at the airport (and/or revoke or suspend any privileges granted to any person or entity) upon determination by the manager that such person or entity has not complied with this chapter, any applicable regulatory measure, any directives issued by the city, or has otherwise jeopardized the safety of persons or entities utilizing the airport or the land and/or improvements located at the airport. 20.01.120 Commercial Use.¶
No person shall carry on any commercial activity or activity for profit at the Montague-Yreka Airport without the consent of the City and the payment of the appropriate fees and charges prescribed for such activity. (Ord. 13-01, 2012)
