16.04.010 - Purpose.

The purpose of this chapter is to implement the requirements of the California Environmental Quality Act of 1970, as amended (Public Resources Code Sections 21000—21174), and the Guidelines for Implementation of the California Environmental Quality Act of 1970 adopted by the Secretary for Resources of the state.

16.04.020 - Application.

This chapter shall apply to each department or office of the county which is responsible for the processing of "projects" or the initiation, processing, review or approval of "environmental impact reports" as the same are defined in the California Environmental Quality Act of 1970.

16.04.030 - Objectives, criteria and procedures.

The board of supervisors shall, by resolution, adopt the objectives, criteria and procedures necessary to carry out the purpose of this chapter. The objectives, criteria and procedures shall be consistent with the guidelines established by the Secretary for Resources, and shall provide for, but not be necessarily limited to, the following:

A. The environmental review and assessment of county projects and the preparation, review and approval of environmental impact reports for such projects;

B. The environmental review and assessment of private projects for which a permit, lease, license, funding or other entitlement of use is required from the county and the preparation, review and approval of environmental impact reports for such projects;

C. The reasonable opportunity for anyone interested in any project to review and comment upon such environmental review and assessment and upon such environmental impact reports prepared by the county;

D. Exemptions of various projects from the requirement of preparation of environmental impact reports;

E. The preparation, notice and filing of negative declarations.

16.04.035 - Mitigation of impacts.

The county shall, as a condition precedent to the issuance of any discretionary permit affecting the use, division or development of real property, impose such mitigation measures upon the permit as may be determined by the planning commission and/or board of supervisors to be necessary or appropriate to mitigate all environmental impacts of the issuance of the permit as identified by the environmental review required by this chapter. The imposition of mitigation conditions under this section may be waived by the board of supervisors upon a finding of overriding concern pursuant to Public Resources Code Sections 21000 et seq.

16.04.040 - Construction.

The provisions of this chapter and the provisions of any resolution implementing this chapter shall be construed so that in the event there is a conflict or ambiguity between the provisions of this chapter and the provisions of any other code, ordinance, resolution or regulation of the county, the provisions of this chapter and the provisions of any implementing resolution shall govern.
