Sec. 14.01.605. - Agreement required for placement of transit shelters and transit…¶
No person shall erect, place, construct or maintain a transit shelter or transit bench on any highway or city property unless said person has entered into an agreement with the city which agreement provides for an exclusive or nonexclusive right to install and maintain transit shelters, transit benches, or both upon a highway or city property at designated locations within the city. The agreement shall provide for the terms and conditions under which transit shelters, transit benches, or both would be installed and maintained within the city and the agreement may include terms relating to designated locations, design, fees payable to city, repair and maintenance, advertising restrictions, term of agreement, remedies for breach, indemnification, financial security, and insurance.

Sec. 14.01.610. - Definitions.¶
The following words, terms, and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
City property means real property owned or controlled by the City of Mission Viejo.
Highway means all or any part of the entire width of right-of-way of a city highway, road, or street, whether or not such right of way is improved or used for highway, road or street purposes.
Transit bench or bench means a seat located upon a highway for the comfort, convenience and accommodation of passersby or persons awaiting transportation.
Transit shelter or shelter means a covered waiting area located upon a highway, often semi-enclosed, with a bench, that provides protection from the sun, wind or rain for passersby or persons awaiting transportation.
