Sec. 1.04.010. - Adoption of seal.

The corporate seal for the city shall be of such design as adopted by the city council from time to time.

Sec. 1.04.020. - Use of the city seal and emblem.

(a) It shall be unlawful for any person, corporation or organization to use the city seal or emblem by affixing a replica of the seal or emblem on any thing, item, or material without first having obtained permission to do so as provided in this section. Each day of any unauthorized use of the city seal or emblem shall constitute a separate offense.

(b) The city manager shall permit the use of the city seal or emblem by any person, corporation or organization ("applicant") when all of the following criteria are met:

(1) The use of the city seal or emblem or any cut, facsimile or reproduction of either of them is for city, local civic, local cultural, local charitable or other local non-profit purpose.

(2) The applicant agrees not to use the city seal or emblem for commercial or other purposes not allowed above.

(3) The applicant pays a fee set by resolution of the city council for processing the application and administering this ordinance.

(4) Samples shall be submitted of all documents, goods and other materials upon which the city seal or emblem is to be used and objective evidence of good quality and workmanship is submitted so that the use of the city seal or emblem on said items does not discredit and impair the integrity of the seal or emblem or cause discredit or ridicule to the city in any manner.

(5) The city shall retain the right, at all reasonable times, to inspect any item upon which the city seal or emblem is used in order that the city may verify that the city seal or emblem is being used correctly in an unadulterated form.

(6) Permission to use the city seal or emblem shall not be assignable.

(7) The use of the seal or emblem is subject to the terms and conditions of that certain license agreement dated April 25, 1994 by and between the San Juan Company, a California Limited Partnership and the City of Mission Viejo, and any amendments thereto.

(8) The use of the seal or emblem may be subject to any reasonable conditions imposed by the city manager to carry out the purposes of this section.

(c) If the applicant breaches any of the criteria set forth above, the city shall serve written notice of such breach upon the applicant with request to cure or take appropriate affirmative action in good faith to cure the breach within thirty (30) days of the date of the notice. In the event the applicant fails to cure the breach to the satisfaction of the city manager, the city manager shall notify the user that the permission to use the city seal or emblem is terminated.
