9-1.01 - Created.

A Planning Commission, which may be known and referred to as the "City Planning Commission" or the "Planning Commission", of, in, and for the City is hereby created and established pursuant to the provisions of the Government Code of the State.

9-1.02 - Membership and qualifications.

The Planning Commission shall consist of five (5) members appointed by a majority of the Council and designated respectively as Commissioner Nos. 1, 2, 3, 4 and 5. All members of the Planning Commission must, at the time of application and throughout the entire term, be residents of or be otherwise employed in, the City.

9-1.03 - Membership: Terms: Vacancies.

Commissioner No. 1 shall be appointed for a term of one year. Commissioner No. 2 shall be appointed for a term of two (2) years. Commissioner No. 3 shall be appointed for a term of three (3) years. Commissioner Nos. 4 and 5 shall be appointed for terms of four (4) years. Upon the expiration of the respective terms of said Commissioners, their respective successors shall be appointed for terms of four (4) years. If a vacancy shall occur otherwise than by expiration of the term, it shall be filled by appointment for the unexpired portion of the term. Nothing contained in this section, however, shall preclude the Council from terminating appointments prior to the expiration of the term thereof.

9-1.04 - Meetings: Place.

Permission is hereby granted to the Planning Commission to use the Council Chamber in the City Hall as the place for its meetings provided such meetings shall not conflict or interfere with meetings of the Council.

9-1.05 - Meetings—Absences.

Notwithstanding any of the other provisions of this chapter, any Planning Commissioner who absents himself from any three (3) regular meetings of the Planning Commission, excused or unexcused, in any calendar year shall thereby automatically forfeit his/her position or office as a member of the Planning Commission. The name of such person shall be automatically removed from the membership of the Commission immediately after the adjournment of any such third regular meeting at which such Commissioner has not appeared.

The Secretary of the Planning Commission shall thereupon promptly notify the City Council and any such person so ceasing to be a Commissioner; whereupon the vacancy so created shall be filled by appointment as set forth in Section 9-1.03 of this chapter.

9-1.06 - Records and reports.

The Planning Commission shall cause proper records to be kept of all its official acts and proceedings and shall make reports to the Council, as set forth in the Government Code of the State.

9-1.07 - Powers and duties.

The Planning Commission and the members thereof shall respectively have and exercise each and all of the powers, duties, rights, privileges, and authorities of City Planning Commissions and of members of such Commissions as set forth in the Government Code of the State, as the same now exists and as the same may hereafter be amended, and shall perform the duties, acts, and functions of such City Planning Commissions, and members thereof, respectively, as set forth in said Government Code and in the manner therein stated. Such Commissioners shall perform the duties provided for in this chapter and in said Government Code without compensation.

Except as otherwise provided in this chapter or by law, the Planning Commission shall have power to, and shall, provide for its own organization; shall adopt rules and regulations for the transaction of business before it; and shall designate the time and place for the regular monthly meetings of the Commission.

The Planning Commission shall have no power or authority to bind or obligate the City or any officer or department thereof for any money, debt, undertaking, or obligation of any kind in excess of the appropriation which the Council may have made for the purposes of the Commission in any fiscal year.

9-1.08 - Duties of City Clerk.

The City Clerk is hereby authorized and instructed to notify the Planning Commission of any matters which may be pending before the Council and to forward to the Planning Commission from time to time any and all documents, proceedings, and instruments which may be so pending and which matters, documents, proceedings, and instruments, according to law, are required to be submitted to the Planning Commission prior to final action thereon by the Council.
