§ 8.32.010. Purpose and findings.

We, the people of Martinez, find the passage of this Act is necessary in order to protect and defend the health and safety of ourselves and our posterity by prohibiting the importation of hazardous wastes and requiring that any hazardous waste facility be approved by a majority vote of the people.

§ 8.32.020. Prohibition of importation of hazardous wastes.

All substances commonly known as "toxic wastes", "chemical wastes", and/or "hazardous wastes" (defined herein below in Sections 8.32.040) which originate and/or are generated outside the City limits of the City of Martinez, shall not be: (a) incinerated; (b) stored for incineration; or (c) otherwise disposed of and/or stored within the City limits of the City of Martinez.

§ 8.32.030. Vote required for approval of hazardous waste facility.

All proposed facilities intended for the: (a) incineration; (b) storage; or (c) disposal by other means, of substances (defined herein below in Sections 8.32.040) which originate and/or are generated outside the City limits of the City of Martinez, shall not be approved without a majority vote of the electorate at a regularly scheduled municipal election.

§ 8.32.040. Hazardous wastes defined.

Hazardous waste subject to this Act shall include those defined by current Sections 25117 of the Health and Safety Code of the State of California and/or as defined by current regulations adopted pursuant to Sections 3001 of the Resource Conservation and Recovery Act, as amended (P. L. 94-580), and/or any additional hazardous wastes defined by substantially similar laws and regulations enacted or adopted hereafter. Therefore, substances subject to this Act, include but are not limited to, the following representative list:
