5.20.010 - Enforcement.

The civil and criminal provisions of this ordinance shall be enforced by those persons or agencies designated by municipal authority. It shall be a violation of this ordinance to interfere with a Community Services Officer in the performance of his/her duties.

5.20.020 - Penalties.

A. Any violation of any provisions of Sections 5.01.010 through 5.01.230, 5.01.260, 5.01.270, and 5.01.290 through 5.12.030 shall constitute an infraction and shall be punishable as described in Section 1.04.010 of this Code. All other violations shall constitute misdemeanors and are punishable as described in Section 1.04.010 of this Code. If a violation is continuing, each day's violation shall be deemed a separate violation.

B. Any offense which would otherwise constitute an infraction shall be deemed a misdemeanor if a defendant has been convicted of three or more violations of this chapter within the twelve (12) month period immediately preceding the commission of the offense. For this purpose, a bail forfeiture shall be deemed to be a conviction of the offense charged.

5.20.030 - Conflicting ordinances.

All other ordinances of the City of Manhattan Beach that are in conflict with this ordinance are hereby re-pealed to the extent of such conflict.

5.20.040 - Severability clause.

If any part of this ordinance shall be held invalid, such part shall be deemed severable and the invalidity thereof shall not affect the remaining parts of this ordinance.
