Manhattan Beach Municipal Code Ch. 14.40 Stopping, Standing or Parking Restricted or Prohibited on Certain Streets

14.40.010 - Twenty-four minute parking or indefinite period.

Green curb marking shall mean no standing or parking for a period of time longer than twenty-four (24) minutes at any time between 8:00 a.m. and 9:00 p.m. on any day, or as otherwise authorized and posted by the City's Traffic Engineer.

When authorized signs, parking meters or curb markings have been determined by the City Traffic Engineer to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle adjacent to any such legible curb marking or sign or parking meter in violation thereof.

The Chief of Police, or any authorized police or parking control officer, is further directed to cite, or cause to be cited, each and every period during which such violation exists according to the time limits posted.

14.40.020 - Penalty.

The violation of any of the provisions of Title 14, Chapter 40 of this Code is subject to a civil penalty, pursuant to Section 40200 et seq. of the Vehicle Code and exceptions thereunder.

14.40.030 - One hour parking.

When authorized signs, parking meters or curb markings have been determined by the City Traffic Engineer to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle between the hours of 8:00 a.m. and 9:00 p.m. on any day for a period of time longer than one (1) hour, or as otherwise authorized and posted by the City's Traffic Engineer.

The Chief of Police, or any authorized police or parking control officer, is further directed to cite, or cause to be cited, each and every period during which such violation exists according to the time limits posted.

14.40.040 - Two hour parking.

14.40.050 - Parking parallel on one-way streets.

A. Subject to other and more restrictive limitations, a vehicle may be stopped or parked within 18 inches of the left-hand curb facing in the direction of traffic movement upon any one-way street unless signs are in place prohibiting such stopping or standing.

B. In the event a highway includes two or more separate roadways and traffic is restricted to one direction upon any such roadway, no person shall stand or park a vehicle upon the left-hand side of such one-way roadway unless signs are in place permitting such standing or parking.

C. The City Traffic Engineer is authorized to determine when standing or parking shall be prohibited upon the left-hand side of any one way street or when standing or parking may be permitted upon the left-hand side of any one-way roadway of a highway having two or more separate roadways and shall erect signs giving notice thereof.

D. The requirement of parallel parking imposed by this section shall not apply in the event any commercial vehicle is actually engaged in the process of loading or unloading freight or goods, in which case such vehicle may be backed up to the curb, provided that such vehicle does not extend beyond the center line of the street and does not block traffic thereby.

14.40.060 - Diagonal parking.

On any of the streets or portions of streets established by resolution of the Council as diagonal parking zones, when signs on pavement markings are in place indicating such diagonal parking, it shall be unlawful for the operator of any vehicle to park said vehicle except:

A. At the angle to the curb indicated by signs or pavement markings allotting space to parked vehicles and entirely within limits of said allotted space;

B. With the front wheel nearest the curb within six (6) inches of said curb.

The provisions of this section shall not apply when such vehicle is actually engaged in the process of loading or unloading passengers, freight or goods, in which event the provisions applicable in Section 14.40.050 of this chapter shall be complied with.

14.40.070 - Parking space markings.

The City Traffic Engineer is authorized to install and maintain parking space markings to indicate parking spaces adjacent to curbings where authorized parking is permitted. Certain parking spaces may be marked to allow parking of compact cars only where a sign or pavement marking gives notice of such limitation.

When such parking space markings are placed on the highway, subject to other and more restrictive limitations, no vehicle shall be stopped, left standing or parked other than within a single space.

14.40.080 - Compact car parking space markings.

The City Traffic Engineer is authorized to install and maintain certain parking space markings adjacent to curbing to allow the parking of compact cars only where a sign or pavement marking gives notice of such limitation.

For purposes of this section, the term compact car shall mean a motor vehicle designed primarily to carry persons and does not exceed 200 inches in overall length.

When such parking space markings are placed on the highway, subject to other and more restrictive limitations, no vehicle including compact cars of others shall be stopped, left standing or parked other than within a single compact car space.

14.40.090 - No stopping zones.

The Chief of Police shall designate established no stopping zones by placing and maintaining appropriate signs indicating that stopping of vehicles is prohibited and indicating the hours and day when stopping is prohibited.

During the hours and on the days designated on the signs, it shall be unlawful for the operator of any vehicle to stop said vehicle on any of the streets or parts of streets established by resolution of the Council as no stopping zones.

14.40.100 - Disabled persons exempt parking.

Paraplegics—Notwithstanding any other provision of this Code, any veteran who is entitled to either of the exemptions provided in Section 9105 of the Vehicle Code and Section 10783 of the Revenue and Taxation Code, shall be allowed to park in restricted zones. This section shall not be construed, however, to allow the stopping, parking, or standing of a vehicle at the times and places that stopping, parking or standing of all vehicles is prohibited absolutely by state law or local ordinance.

14.40.110 - Driving and parking on public property.

A. Wherever the City Manager shall determine that the orderly, efficient conduct of the City's business requires that parking, standing or driving of vehicles on City property be prohibited, limited or restricted, the City Manager shall have the power and authority to order signs to be erected or posted indicating that the parking, standing or driving of vehicles is thus prohibited, limited or restricted.

B. When signs authorized by the provisions of this chapter are in place, giving notice thereof, no person shall park, stand or drive any vehicle contrary to the directions or provisions of such signs.

C. No person shall park, stand or drive any vehicle, whether attended or unattended, in any public driveway. No person shall park, stand or drive any vehicle upon any public property, except a highway, without the express or implied consent of the owner or person in lawful possession of such driveway or property.

This action does not prohibit any act, either expressly authorized or expressly prohibited by either Section 602 of the Penal Code or Section 21113 of the Vehicle Code of the State of California or by any other State law.

14.40.120 - Driving and parking on private property.

A. No person shall park, stand or drive any vehicle on any private property or driveway without the express implied consent of the owner or person in lawful possession of each driveway or property.

B. When signs authorized by the provisions of this chapter are in place, giving notice thereof, no person shall park, stand or drive any vehicle contrary to the directions or provisions of such signs.

This action does not prohibit any act, either expressly authorized or expressly prohibited by either Section 602 of the Penal Code or Section 21113 of the Vehicle Code of the State of California or by any other State law.

14.40.130 - Parking definitions.

A. "Private property" as used in this chapter, shall mean any property other than public streets, public alleys, public easements, public rights-of-ways, public parks, or real property owned by the City for governmental purposes as in its governmental capacity.

B. "Posted property" as used in this chapter shall mean public property or any private property enclosed on at least three (3) sides by a hedge, fence, wall, curbing, or other continuous obstruction at least four (4) inches in height and easily visible, or by a building, and along the boundaries of which said parcel of land there is posted a sign meeting the standards set forth in Section 14.40.140.

14.40.140 - Sign standards.

A. Posted private property as used in this chapter shall require signs of at least seventeen inches (17″) by twenty-two inches (22″) constructed in a strong manner of wood, metal, or equally substantial material on which are printed the words, "Private Property - No Trespassing - Sec. 14.40.120, Manhattan Beach Municipal Code - Police Department."

B. Posted private public property as used in this chapter shall require signs constructed in a standard manner of wood, metal, or equal substance material upon which are printed those words indicating that parking, standing, or driving vehicles on said public property is thus prohibited, limited, or restricted.

14.40.150 - Parking in public parking lots.

If a person allows a vehicle to remain on a public parking lot after closing and then requests assistance to exit the lot, upon such assistance being provided, a citation shall be issued for violation of this section.

14.40.160 - Parking in front of and/or opposite garages and carports.

When authorized signs are in place giving notice thereof, no person shall park or permit to be parked or left standing any automobile, motor vehicle or other vehicle in front of, or across the driveway from, or opposite or across the roadway from, any garage or carport on any of those streets, places, or roadways set forth in any ordinance or resolution of this City designating and describing any street or portion thereof for this purpose. When authorized signs are in place giving notice thereof, any vehicle parked or left standing in violation of this section may be removed pursuant to the provisions of Section 14.08.100.

14.40.170 - Restriction of parking on certain streets to residents.

When authorized signs are in place giving notice thereof, no person shall park or permit to be parked or left standing any automobile, motor vehicle, or other vehicle during all or certain hours of the day and on those certain streets as established by the Council under separate resolution; provided that preferential parking privileges shall be given to residents adjacent to such streets designated in said resolution and such residents may be issued a permit at a fee established by the resolution which exempts them from the prohibition or restriction of this ordinance and the resolution adopted thereunder.

14.40.180 - Parking spaces for the exclusive use of disabled persons.

A. It shall be unlawful for any person to park in any designated disabled space or stall or adjacent space designated for the loading and unloading of such persons without displaying a license plate or placard issued to them under Section 5007 of the California Vehicle Code or Section 22511.55 of the California Vehicle Code.

B. The Building Division of the Community Development Department is hereby authorized to designate stalls or spaces for the exclusive use of disabled persons in privately owned parking facilities.

C. The Public Works Department is hereby authorized to designate stalls or spaces for the exclusive use of disabled persons on public property and public off-street parking facilities.

14.40.200 - False and misleading signs prohibited.

Any person who places or maintains on their property a sign which falsely and misleadingly gives the impression that parking is prohibited or attempts in any way to give the impression that it imposes any other parking or traffic regulation or limitation on the use of the public right of way shall be guilty of a misdemeanor.
