1.16.010. - Authority.

This chapter is enacted pursuant to the provisions of Penal Code §§ 836.5 and 853.5.

1.16.020. - Town officers authorized to issue notice to appear.

Pursuant to Penal Code §§ 836.5 and 853.5, officers or employees of the Town are authorized to issue notices to appear, subject to the limitations hereinafter provided, where there is reasonable cause to believe that the person cited has violated a statute, ordinance, or order which such officer or employee, or designee, has the duty or authority to enforce.

1.16.030. - Citation procedure.

The officers and employees enumerated under Section 1.16.020 shall be authorized to issue notices to appear in court as prescribed by Penal Code §§ 853.5 through 853.85. If a violator to whom a notice is given fails to give his or her promise to appear, the individual giving the notice shall refer the notice to appear to the district attorney and shall not take the violator into custody.

1.16.040. - Violation of promise to appear.

Any person who willfully violates his or her written promise to appear in court is guilty of a misdemeanor, regardless of the disposition of the charge set forth in the notice to appear.

1.16.050. - Warrant for arrest upon failure to appear.

When a person signs a written promise to appear at the time and place specified in the written promise to appear and has not posted bail as provided in Penal Code § 853.6, the magistrate shall issue and have delivered for execution a warrant for such person's arrest as provided in Penal Code § 853.8.

1.16.060. - Procedures and remedies.

The procedures and remedies provided for this Code are cumulative of all other remedies provided by Federal, State or local laws, ordinances, and regulations. The Town may employ or utilize any or all such additional procedures or remedies, whether criminal, civil, administrative, or of another nature.
