§ 5-2.01 DEFINITIONS.¶
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
FOOD HANDLING ESTABLISHMENT. Any restaurant, itinerant restaurant, coffee shop, cafeteria, short-order cafe, luncheonette, tavern, sandwich stand, soda fountain, delicatessen, bakery, grocery, confectionery, meat market and any other establishment which manufactures, processes, caters, stores, displays, sells or offers for sale to the public food or drink, wholesale or retail, simple or compound, as well as rooms in which food or drink is prepared for sale or distribution elsewhere.

§ 5-2.02 FOOD HANDLING ESTABLISHMENTS; PERMIT REQUIRED.¶
(A) Each food handling establishment shall obtain a permit from the Health Officer. An application for the permit, upon a form to be provided by the Health Officer, shall be filed by each food handling establishment with the Health Officer. The Health Officer thereupon shall issue to each applicant a permit, provided that satisfactory proof is presented to the Health Officer that each owner, operator, manager, and employee of the food handling establishment has had issued to him or her a registration card as provided by this chapter.
(B) All permits shall be valid for a period of one year from the date of issuance thereof unless the same are sooner suspended or revoked.

§ 5-2.03 REGISTRATION OF PERSONNEL.¶
(A) Approval of Health Officer. It shall be unlawful for any owner, operator, manager, or employee of any food handling establishment to work or employ personnel in any food handling establishment until he or she has been registered with and approved by the Health Officer. It shall be the duty of every operator, manager, or employee, before he or she is employed in any food handling establishment, and annually thereafter, to register with the Health Officer and apply for a registration card. The issuance of a registration card to a person shall be deemed approval of the Health Officer to the person to work in the food handling establishment.
(B) Chest X-ray. Each person applying for a registration card shall give accurate and verified information concerning his or her health and shall be required to submit to a chest X-ray 70 mm to determine his or her freedom from tuberculosis. The Health Officer shall not issue a registration card until the chest X-ray has been taken. The Health Officer may issue the registration card immediately upon application and the taking of the chest X-ray, but in the event that subsequent examination of the chest X-ray indicates that the chest examination is positive, the Health Officer shall immediately revoke or suspend the registration card.

§ 5-2.04 REVOCATION AND SUSPENSION OF REGISTRATION CARD.¶
It shall be unlawful for any owner, operator, manager, or employee to work in any food-handling establishment when the registration card issued to him or her has been revoked or suspended by the Health Officer. Upon the
revocation or suspension of any registration card by the Health Officer, the employee or food handling establishment adversely affected may demand a hearing before the Health Officer, which hearing shall be set by the Health Officer not later than 30 days after the demand has been filed. The decision of the Health Officer may be reviewed by the Council upon its own motion or upon the request of any interested person in connection with such proceeding.
