§ 3-5.01 UNIFORM TRAFFIC ORDINANCE.¶
Pursuant to Cal. Gov't Code §§ 50022.1 through 50022.4, inclusive, the text of that certain publication of the League of California Cities entitled "Uniform Traffic Ordinance" is adopted and incorporated in this chapter as the rules, regulations, and standards within the city as to all matters pertaining to traffic therein contained except as otherwise provided in this chapter. Three copies of the Uniform Traffic Ordinance are and shall at all times be on file for use and examination by the public in the office of the City Clerk.

§ 3-5.02 CENTRAL TRAFFIC DISTRICT.¶
(A) Section 1.3 of Article I of the Uniform Traffic Ordinance is amended to read as follows in § 3-5.02(B). (B) Section 1.3. All streets and portions of streets within the area described as follows are declared to be within the Central Traffic District: all that area bounded by East Fifth Street from North E Street to North B Street; North B Street from East Fifth the northerly side of Yosemite Avenue; the northerly side of Yosemite Avenue from North B Street to North Lake Street; to and along the southerly side of Yosemite Avenue from North Lake Street to South B Street from the south side of Yosemite Avenue to East Sixth Street; East Sixth Street from South B Street to South C Street; South C Street from East Sixth Street to East Seventh Street; East Seventh Street from South C Street to South E Street from East Seventh Street to East Fifth Street.

§ 3-5.03 CITY TRAFFIC ENGINEER.¶
(A) Section 2.5 of Article II of the Uniform Traffic Ordinance is amended to read as follows in § 3-5.03(B).
(B) Section 2.5. The office of City Traffic Engineer is established. The City Engineer shall serve as City Traffic Engineer in addition to his or her other functions and shall exercise the powers and duties with respect to traffic as provided in this chapter.

§ 3-5.04 TRAFFIC COMMITTEE.¶
(A) Section 2.7 of Article II of the Uniform Traffic Ordinance is amended to read as follows in § 3-5.04(B).
(B) Section 2.7. There is established an advisory Traffic Committee, to serve without compensation, consisting of the City Engineer, Assistant City Engineer, Public Works Director, Street Supervisor, and the Police Chief or a designated representative. The chairman of the Traffic Committee shall be appointed by, and may be removed by, the Mayor.

§ 3-5.05 TRAFFIC BARRIERS.¶
(A) Article VIII of the Uniform Traffic Ordinance is amended by adding thereto a new section to be designated § 8.9 to read as follows in § 3-5.05(B).
(B) Section 8.9. No person shall operate a vehicle contrary to the directions or provisions of any barrier or sign erected:
(1) Pursuant to the provisions of any ordinance of the city; or
(2) By any public authority; or
(3) By any department of the city; or
(4) By any other person pursuant to law or contract with the city; nor shall any unauthorized person move or alter the position of any such barrier or sign.

§ 3-5.06 TAXICAB STANDS.¶
(A) Article XII of the Uniform Traffic Ordinance is amended by adding thereto a new section to be designated § 12.7 to read as follows in § 3-5.06(B).
(B) Section 12.7. The City Traffic Engineer shall establish taxicab stands and determine the location thereof. The curb surfaces within each taxicab stand shall be painted white and marked "Taxicab Stand" in red lettering or shall be designated by markings and/or signs of a size and type approved by the City Traffic Engineer. No operator of any vehicle, other than a taxicab or automobile for hire, shall park any vehicle in such taxicab stand.

§ 3-5.07 PARKING VIOLATIONS.¶
(A) Article III of the Uniform Traffic Ordinance is amended by amending § 3.9 thereof, to read as follows in § 3- 5.07(B).
(B) Section 3.9. In addition to the procedures authorized by the provisions of the State Vehicle Code or any other applicable law, rule, policy, procedure, or regulation, vehicles parked in violation of the terms and provisions of any of the regulations promulgated hereunder shall be cited for such violation as hereinafter set forth. The Council has the authority to establish policies and procedures by resolution; or in the alternative, by resolution, authorize the City Administrator to adopt administrative policies and procedures to be followed in the processing of alleged violations of parking codes under the City Municipal Code, these regulations, and state law. The officer or person authorized to enforce the terms and provisions of the traffic regulations of the city upon observing a vehicle in violation thereof shall issue a citation to be attached to the vehicle providing written notice of the violation, amount of the bail, and the address of the City Department of Finance to whom payments thereof shall be sent or delivered. The statement that payment of the bail for such parking offense may be sent through the mail shall be in bold print. The notice shall also provide that bail for the violation is $10 if paid within 15 working days after the date of issuance of citation and $20 if paid after 15 days, but not less than 30 days after the date of violation. The foregoing schedule of bail shall remain in full force and effect unless modified by resolution of the City Council. In the event a citee of a parking violation fails to post the appropriate bail either within the initial 15-day period or the subsequent 15-day period, the Director of Finance is authorized and directed to provide the State Department of Motor Vehicles with notice of the violation, together with the license number of the vehicle involved and a request to collect the sum due the city upon registration of the vehicle involved in accordance with policies and procedures duly adopted by the city. In the event a person wishes to contest the allegations set forth in the citation, the citation shall state the process that such owner or operator must follow in order to contest the allegations set forth in the citation pursuant to all applicable state law and all policies and procedures duly adopted by the city. Any and all funds collected for violations within the City Downtown Parking District that are not required to be paid over to the county or the state pursuant to state law or city policies and procedures shall be kept in a separate fund for the purpose of maintenance, operation, and other purposes as set forth in the City's Downtown Parking District regulations.

§ 3-5.08 INCREASING STATE SPEED LIMIT IN CERTAIN ZONES.¶
(A) Section 16 of Article XVI of the Uniform Traffic Ordinance is amended to read as follows in § 3-5.08(B).
(B) Section 16. It is determined upon the basis of an engineering and traffic survey that the speed permitted by state law upon the following streets is less than is necessary for the safe operation of vehicles thereon by reason of the designation and sign-posting of such streets as through highways and/or by reason of widely-spaced intersections and it is declared that the prima facie limit shall be as set forth in this section on those streets, or parts of streets, designated in this section when signs are erected giving notice thereof:

§ 3-5.09 DECREASE OF STATE LAW MAXIMUM SPEED; REPEALS.¶
(A) Section 16.1 of Article XVI of the Uniform Traffic Ordinance is amended to read as follows in § 3-5.09(B).
(B) Section 16.1. It is determined upon the basis of an engineering and traffic investigation that the speed permitted by state law outside of business and residence districts as applicable upon the following street or streets is greater than is reasonable or safe under the conditions found to exist upon such street or streets, and it is declared that the prima facie speed limit shall be as herein set forth on those streets or parts of streets herein designated when signs are erected giving notice thereof:

§ 3-5.10 REGULATION OF PARKING LOTS.¶
(A) The Uniform Traffic Ordinance is amended by adding thereto a new numbered Article XVII to read as follows in § 3-5.10(B).
(B) Article XVII, regulation of parking lots, § 17. The City Traffic Engineer is directed to place and maintain any traffic control devices upon any city parking lot necessary to implement any rules or regulations applicable thereto established by resolution of the City Council.

§ 3-5.11 SPEED OF TRAINS.¶
(A) Article XV of the Uniform Traffic Ordinance is amended by adding thereto a new section to be designated § 15.2 to read as follows in § 3-5.11(B).
(B) Section 15.2. It shall be unlawful for any person, firm, or corporation to operate any railroad train within the city limits of the city at a speed in excess of 45 MPH.

§ 3-5.12 PARADES AND ASSEMBLIES.¶
(A) Article VIII of the Uniform Traffic Ordinance is amended by adding thereto a new section to be designated § 8.10 to read as follows in § 3-5.12(B).
(B) Section 8.10. parades and assemblies.
(1) Definitions.
(a) PARADE. Any march or procession of persons or animals or vehicles, or any combination thereof, except funeral processions over or upon any public street, sidewalk, alley, or other public place, which march or procession does not comply with normal and usual traffic regulations or controls.
(b) ASSEMBLY. Any congregation, meeting, or gathering of persons and/or objects upon any public street, sidewalk, alley, or public place so as to obstruct the free passage or use of any such street, alley, sidewalk, or place.
(2) No person shall conduct, manage, or participate in any parade or assembly in the city without a written permit therefor having been issued by the Chief of Police.
(3) No permit shall be issued authorizing the conduct of a parade or assembly which the Chief of Police finds is proposed to be held for the sole purpose of advertising any product, goods, wares, merchandise, or event and is designed to be held purely for private profit.
(4) The Chief of Police shall issue a permit if he or she finds all of the following:
(a) That the conduct of the parade or assembly will not substantially interrupt the safe and orderly movement of traffic at the point of assembly or contiguous to a parade route;
(b) That the conduct of the parade or assembly will not require the diversion of so great a number of police officers of the city to properly police the area as to prevent normal police protection to the city;
(c) That the conduct of the parade or assembly will not interfere with the movement of fire-fighting equipment en route to a fire;
- (d) That the conduct of the parade or assembly is not reasonably likely to cause injury to persons or property or to provoke disorderly conduct or create a disturbance; and
(e) That any such parade will move from its point of origin to its point of termination expeditiously and without stopping en route.
(5) The Chief of Police is authorized to impose any and all reasonable conditions to the issuance of any permit required by the provisions of this section to ensure the safety of persons and property.
(6) The permit issued by the Chief of Police shall contain its date of issuance, the name of the person or
organization applying therefor, the specific event, the conditions of issuance, if any, and, in cases of parades, the route and starting time.
(7) The Chief of Police shall act upon the application for a parade or assembly permit within 30 days after the filing thereof. If the application is denied, the Chief of Police shall mail to the applicant within 30 days after the filing of the application for the permit a notice of this action, stating the reasons for the denial of the permit. Any person desiring to appeal from such decision may do so in the manner set forth in Chapter 4 of Title 1 of the City Municipal Code.

§ 3-5.13 USE OF CROSSWALKS.¶
(A) Section 9.1 of Article IX of the Uniform Traffic Ordinance is amended to read as follows in § 3-5.13(B).
(B) Section 9.1. No pedestrian shall cross a roadway other than by a crosswalk in the central traffic district or in any business district; provided, however, this prohibition shall not apply to pedestrians crossing Yosemite Avenue between B and C Streets, C and D Streets, and D and E Streets at alleys in the middle of such blocks. Nothing in this section shall be construed to allow the crossing of any street between adjacent intersections other than in a crosswalk where such intersections are controlled by traffic control devices or police officers. § 3-5.14 RESTRICTION OF USE OF CERTAIN VEHICLES.¶
(A) Article XIII of the Uniform Traffic Ordinance is amended to change the title thereto to "Restricted Use of Certain Streets and Areas" and by adding thereto § 13.5 to read as follows in § 3-5.13(B).
(B) Section 13.5. motor driven vehicles prohibited in parks. No person shall operate or drive any automobile, motorcycle, minibike, trail bike, or any other motor-driven vehicle of any kind within the confines of any city-owned park, parkway, including walkways, trails, and paths, or any area within a city-owned park, except upon a regularly established public street designated for vehicular travel within any such park.

§ 3-5.15 UNATTENDED TRUCK AND TRAILER PARKING PROHIBITED.¶
(A) Chapter XI of the Uniform Traffic Ordinance is amended by adding thereto a new section to be designated § 11.9 to read as follows in § 3-5.15(B).
(B) Section 11.9. unattended truck trailer parking prohibited. No person shall park any truck trailer on any street in the city which trailer is not connected to a truck tractor or other motor vehicle capable of moving such trailer at all times, except when a permit is granted by the Police Chief, or his/her designated representative. Permits shall not be granted in residential zones and shall not be issued more than three times per calendar year per permittee. A permit issued under this section does not authorize the violation of any other provisions of the Uniform Traffic Ordinance.
(C) Truck parking prohibited in certain areas.
(1) No person shall park any commercial motor vehicle as that term is defined in the California Vehicle Code on any residential street, or any street which is residential in nature, within the city. This sub-section shall not apply to a commercial motor vehicle which is engaged in the active loading or unloading of goods.
(2) No person shall park any commercial vehicle at the curb or shoulder along streets designated by the City Engineer and posted accordingly where parking of such commercial vehicles represent a public nuisance or is likely to be detrimental to public peace, safety, and health or welfare. This section shall not apply to a commercial vehicle which is engaged in the active loading or unloading of goods or providing service.

§ 3-5.16 REPEAL OF MOBILE VENDOR PARKING REQUIREMENTS.¶
Chapter X of the Uniform Traffic Ordinance is amended by repealing subsection (a) of section 10.11 of Chapter X relating to Unlawful Parking - Peddlers, Vendors.

§ 3-5.17 LIMITATIONS ON TIMED PARKING RESTRICTIONS.¶
(A) The time limits for parking imposed by §§ 11, 11.1, 11.2, and 11.3 of the Uniform Traffic Ordinance shall not apply to those persons listed in paragraph (B) hereof, where the vehicle parked displays a special license plate issued by the Department of Motor Vehicles authorized by §§ 5101.3 through 5101.7 of the California Vehicle Code, and where the person to whom such license plates were issued is either operating, or is a passenger, in the vehicle.
- (B) The following persons are exempt as noted in paragraph (A):
(1) Honorably discharged veterans of the Armed Forces of the United States who are survivors of Pearl Harbor;
(2) Active or honorably discharged members of the Armed Forces of the United States who are recipients of the Army Medal of Honor, Navy Medal of Honor, Air Force Medal of Honor, Army Distinguished Service Cross, Navy Cross, or the Air Force Cross;
- (3) Veterans of the Armed Services of the United States who are former prisoners of war;
(4) Active or honorably discharged members of the Armed Forces of the United States who are recipients of the Congressional Medal of Honor, or Medal of Honor;
- (5) Active or honorably discharged members of the Armed Forces of the United States who are recipients of the Purple Heart.
(C) Any peace officer or parking control officer employed by the city is encouraged to exercise discretion in enforcing the Uniform Traffic Ordinance sections noted in paragraph (A) with respect to any vehicle displaying a
similar special license plate from any other state.

§ 3-5.18 PARKING FOR PERIOD EXCEEDING 120 HOURS.¶
(A) It shall be unlawful to park, leave standing or store a vehicle, as that term is defined in the Vehicle Code, upon any street or alley of the city for any period exceeding 120 consecutive hours.
(B) Any vehicle parked contrary to the provisions of subsection (A) of this section shall be subject to removal in the manner provided by and subject to the requirements set forth in the Vehicle Code of the state. (Ord. 835 C.S., passed 5-21-08)
