Chapter 3.80 — ADVERTISING ON COUNTY PROPERTY

3.80.010 - Non-public forum—Purpose.

The county property upon which advertising is permitted by this chapter is declared to be a non-public forum. As a non-public forum, the county reserves the right to discontinue advertising on county property as deemed appropriate by the board of supervisors. Advertising on county property is for the purpose of revenue generation for the county.

3.80.020 - Content neutral.

Advertising on county property permitted by this chapter shall be content neutral, i.e., advertising shall not advocate a person or point of view, and shall be free of political or religious content.

3.80.030 - Commercial advertising.

Advertising on county property upon which advertising is permitted by this chapter shall be commercial advertising, that is, it shall propose a commercial transaction (sale) only; other types of advertising are prohibited.

3.80.040 - Misrepresentations.

Advertising that contains fraudulent, deceptive, or misleading statements, copy, or illustrations is prohibited. Advertising may not state or imply an endorsement of the advertiser, product or service, by the county of Madera.

3.80.050 - Attacks, criticism, and violence.

Advertising that contains or depicts attacks or criticism of a commercial or personal nature or is demeaning or disparaging is prohibited. Advertising that promotes, advocates, or depicts violence is prohibited.

3.80.060 - Offensive content.

Advertising of tobacco or alcohol products is prohibited. Advertising of a sexual or bodily function nature, activity or product is prohibited. Advertising containing profane, vulgar, or obscene words, statements, copy, illustrations or the like is prohibited. Advertising of gaming activities or wagering is prohibited.

3.80.070 - Legal compliance.

Advertising of products or services that are subject to one or more federal, state, or local laws, ordinances, or regulations must be in compliance therewith.

3.80.080 - Allowed county property forums.

Advertising on county property shall be limited to the county's website.

3.80.090 - Advertising submittal and review.

Advertisements proposed for county property are subject to review and approval by the county for compliance with this chapter. Not all advertising proposed will be accepted due to space limitations.

3.80.100 - Advertising review committee.

The board of supervisors shall, by resolution, establish an advertising review committee. The chief function of the advertising review committee shall be to review proposed advertising for compliance with this chapter. Advertising review and other functions of the committee shall be as provided by board resolution.

3.80.110 - Advertising rates.

The board of supervisors shall, by resolution, establish rates for advertising on county property.

3.80.120 - Advertising terms and conditions.

Other terms and conditions pertaining to advertising on county property, including but not limited to technical specifications and requirements, shall be as provided by resolution of the board of supervisors.

3.80.130 - Madera County business directory.

Separately from the commercial advertising contemplated by this chapter, the county of Madera may establish a list of businesses, nonprofit and service organizations situated within the boundaries of Madera County. The business directory shall be accessible via the county's website. The business directory listings shall be in alphabetical order, and shall contain only name, address, telephone number, website and/or e- mail address, if any, and type of business. The business directory may be discontinued at any time as deemed appropriate by the board of supervisors.
