11.06.010 Application of Chapter¶
The provisions of this chapter 11.06 shall apply to outdoor domestic water use by all residential customers served with water by the City of Loyalton, and shall be in effect from May 1st through August 31st each year. If it appears to the City Council that it is necessary to do so to prevent water shortages, the City Council may, by resolution, lengthen this period by commencing it sooner or extending it later in the year.
11.06.020 Urgency Ordinance¶
This ordinance shall take effect immediately upon its introduction as an emergency ordinance pursuant to Government Code Section 36937. The following declaration states the facts and findings constituting an urgency: It is hereby declared that the addition of an ordinance establishing water use restrictions is necessary to preserve the health, safety and general welfare of persons residing or working in the City of Loyalton, to ensure a sufficient water supply during the summer months and to preserve the general welfare of the City.
11.06.030 Temporary Suspension by City Council¶
The City Council may, by resolution, suspend the restrictions imposed herein for all or any portion of the annual period during which this chapter applies. No such suspension shall operate or be construed as a waiver of this chapter by the City, nor shall any such suspension affect the subsequent validity or enforcement of this chapter.

11.06.040 Watering Schedules¶
Residential water users with street addresses ending in an even number may water on Thursdays and Sundays only. Residential water users with street addresses ending in an odd number may water on Wednesdays and Saturdays only. All other water users, including commercial users, schools, parks, and churches, may water on Tuesdays and Fridays only. No water user shall water on Mondays. Watering may occur at any time except between the hours of 1:00 p.m. and 5:00 p.m.
11.06.050 Prohibited Uses of Water¶
Water shall not be used for washing of motor vehicles, trailers, boats, and other types of mobile equipment, or for cleaning sidewalks or gutters, except that vehicle washing may be done on the premises of a commercial carwash or with reclaimed wastewater.
11.06.060 Penalties¶
The following penalties shall be imposed for violations of the water use restrictions in this chapter.
A. For the first and second violations, the City shall issue a written notice of violation to the customer or person violating the restrictions. B. For the third violation by any customer within any twelve (12) month period, a penalty in the sum of fifty dollars ($50.00) shall be added to the customer’s water bill. C. For the fourth violation and any subsequent violation by any customer within any twelve (12) month period, a penalty in the sum of one hundred dollars ($100.00) shall be added to the customer’s water bill. The fourth and any subsequent violation by a person during any twelve (12) month period shall constitute an infraction. D. For the fifth violation and any subsequent violation by any customer within twelve (12) month period, the City may shut off water service to the customer until the accumulated penalties have been paid in full.
