§ 22.10

Sec. 22.10.010. - Definition.

For the purpose of this article, the term "unit" is defined as follows:

(1)

Each available trailer space of a trailer court, whether occupied or not, is one (1) "unit."

(2)

A duplex, whether occupied or not, shall constitute two (2) "units."

(3)

Each separate apartment in an apartment house, whether occupied or not, shall constitute one (1) "unit."

(4)

Each housing accommodation designed for occupancy by a single person or one (1) family, irrespective of the number actually occupying such accommodation and whether occupied or not, in a "court" or a "flat" shall constitute one (1) "unit."

Each room of a lodginghouse, boardinghouse or hotel or other multiple dwelling designed for sleeping accommodations for one (1) or more individuals, whether occupied or not, shall constitute one (1) "unit."

Sec. 22.10.015. - Connection fees for certain areas of Town.

With respect to that portion of the Town which was tributary, as of December 1, 1958, to the Unit V trunk sewer at Roberts Road of West Valley Sanitation District of the County, connectors (i.e., any person who connects any building sewer, lateral sewer or house sewer to any main or trunk sewer owned by the Town) and installers (i.e., any person who installs main or trunk sewers within the Town for connection to the Town's sewerage system), shall pay to the Town the same connection fees as are charged by such West Valley Sanitation District for similar connections made within the balance of the Town, and in the same manner as set forth in Article VII of Ordinance No. 10, as amended, of such West Valley Sanitation District, and the agreement made by the Town and such West Valley Sanitation District on December 1, 1958.

Sec. 22.10.020. - Premises outside Town using Town sewerage system—Application for…

Application for a sewer connection for premises outside of the Town which is to be connected with the sewerage system of the Town, or which is to discharge sewerage which ultimately passes through the sewerage system of the Town shall be made directly to the Board of Directors of West Valley Sanitation District of the County, and a copy of the application shall be presented to the Town Council. The Town Council reserves the right to determine whether or not the application will be accepted or rejected.

Sec. 22.10.025. - Same—Connection and inspection fees.

(a)

The connection and inspection fees for single-family dwellings outside the Town under section 22.10.020 shall be in such amounts as established by Council resolution from time to time. Such fees shall be payable in advance to the Town by the applicant for connection.

(b)

For other than single-family dwellings the connection and inspection fees shall be in such amounts as established by Council resolution from time to time, and shall be payable in advance directly to the Town by the applicant.

Sec. 22.10.030. - Remedies cumulative.

The conviction and finding or imprisonment of any person for a violation of this article shall not relieve such person from paying the charges, penalties, and interest provided for in this article, nor shall the payment thereof prevent a criminal prosecution for the violation of any of the provisions of this article. All remedies prescribed hereunder shall be cumulative and the use of one (1) or more remedies by the Town shall not bar the use of any other remedy for the purpose of enforcing this article.

Sec. 22.10.035. - Use fees.

Fees for use of the Town's sewerage system shall be as established and collected by the West Valley Sanitation District. Additional permits may be required for street excavations or plumbing.
