Sec. 18.40.055. - Definitions.

For the purposes of this division, the following words and phrases shall have the meanings respectively ascribed to them by this section:

Gamble means any game not mentioned in section 330 of the Penal Code of the State played, conducted, dealt or carried or with cards, dice or other devices for money, checks, chips, credits, pennants, cigars, candy, merchandise or other valuable thing or representative of value.

Gambling room means any location within the Town which is used or offered for use, in whole or in part, as a regular business enterprise, for the playing, conducting, dealing or carrying on of any game not mentioned in section 330 of the Penal Code of the State with cards, dice or other devices for money,

checks, chips, credits, pennants, cigars, candy, merchandise or other valuable thing or representative of value.

Sec. 18.40.060. - Gambling rooms prohibited.

(a)

No person, either as principal, agent, employee or otherwise, shall keep, conduct or maintain any building, premises, room, site or place within the Town as a gambling room.

(b)

No person, either as principal, agent, employee or otherwise, shall permit any building, premises, room, site or place within the Town, owned, managed, supervised, possessed or controlled by such person, to be used or offered for use as a gambling room.

(c)

It is the intent of this section to prohibit the keeping, conducting or maintenance of locations within the Town where gambling takes place as a regular business enterprise, and to prohibit gambling at such locations. Without limitation to the generality of the preceding, it is the intent of this section to prohibit places customarily known as card rooms.

Sec. 18.40.065. - Exceptions.

The provisions of section 18.40.060 shall not apply to any bona fide charitable, religious, fraternal, benevolent or educational organization which qualifies under the laws of the State as exempt organizations under either the Gift Tax Law, Inheritance Tax Law or Personal Income Tax Law, nor to any location in which the sole card game played is bridge or whist.
