Division 5 — PENSIONS

Editor's note— Ord. No. 1937, § I, adopted Apr. 19, 1993, repealed §§ 2.30.705, 2.30.715 and 2.30.725— 2.30.820, relative to pensions, and renumbered and amended the remaining provisions of this division to read as herein set out. The repealed provisions derived from Code 1968, §§ 20-1, 20-3, 20-4—20-15, 20- 17.

The purpose of this division is to establish a retirement plan and provide related benefits for certain employees of the Town.

(a)

Approval. The Town Council hereby approves, pursuant to the provisions of Government Code section 20460, that agreement by and between the Town and the Board of Administration of the Public Employees' Retirement System entitled "Contract Between Board of Administration, Public Employees' Retirement System and The Town Council of The Town of Los Gatos," a copy of which is on file in the office of the Town Clerk, and by this reference incorporated herein, if, as and when Ordinance No. 996 of the Town, enacted by the Town Council on February 16, 1970, becomes effective. If, as and when Ordinance No. 996 becomes effective, the Town Council hereby authorizes and directs the Mayor to execute such agreement for and in behalf of the Town Council and the Town at any time between April 23, 1970, and April 28, 1970.

Authorized. A contract between the Town Council and the Board of Administration, State Public Employees' Retirement System is hereby authorized, a copy of such contract being attached to the original of Ordinance No. 1059, marked "Exhibit A," and by such reference made a part hereof as though herein set out in full. The Vice-Mayor of the Town Council is hereby authorized, empowered, and directed to execute such contract for and on behalf of such agency.

Amendment. An amendment to the contract between the Town Council and the Board of Administration, State Public Employees' Retirement System is hereby authorized, a copy of such amendment being attached to the original of Ordinance No. 1071, marked "Exhibit A," and by such reference made a part hereof as though herein set out in full. The Mayor of the Town Council is hereby authorized, empowered, and directed to execute such amendment for and on behalf of such agency.
