Los Altos Municipal Code Ch. 9.12 Roadway Solicitation

As used in this chapter, the following words and phrases shall have the following meaning:

"Median strip" shall mean a paved or planted strip of ground dividing a roadway into lanes according to the direction of travel.

"Roadway" means that portion of a public street normally or ordinarily used for motor vehicle travel. "Roadway" does not include driveways, sidewalks, curbs, other areas adjacent to public streets, or other areas out of or off of the public streets.

"Roadway" shall also include median strip.

"Solicit" or "solicitation" refers to any transaction or attempted transaction involving an offer of goods, property or services, or a request for money, property or services.

A.

It shall be unlawful for any person traveling in any unparked vehicle to solicit, or attempt to solicit any person.

B.

It shall be unlawful for any person to stand in the roadway and solicit, or attempt to solicit from the occupants of any unparked vehicle.

No signs shall be posted in any part of the city prohibiting solicitation under this chapter unless such signs clearly state that solicitation outside of the roadway or from lawfully parked vehicles is permitted.

Violation of this chapter is an infraction, punishable as provided by this code.

The chief of police shall submit an annual report to the city council setting forth the number of citations issued pursuant to Section 9.12.020 by month for the previous twelve (12) month period.
