§ 2.32.010. Consolidated election date.

Pursuant to the authorization contained in Section 36503.5 of the Government Code of the state of California, the town establishes the date on which its general municipal election shall be held to be the same date as the day of the state-wide general election.

§ 2.32.020. Continuation in office.

Pursuant to Section 36503.5(d) of the Government Code of the state of California all elected town officers and all town officers appointed to elective offices, whose terms of office would have, prior to the adoption of this ordinance, expired on the Tuesday succeeding the second Tuesday in April of an even-numbered year, shall instead continue in their offices until no later than the fourth Tuesday after the day of the general municipal election, and until their successors are elected and qualified.

§ 2.32.030. Term of office of councilmembers appointed to fill vacancies on town council.

Pursuant to Section 36512(c)(3) of Government Code of the state of California, any person appointed by the town council to fill a vacancy on the town council whose appointment takes effect following the effective date of the ordinance codified in this section shall hold office only until the date of a special election which shall be immediately called by the town council to fill the remainder of the unexpired term of the former incumbent of that elective office. The special election shall be held on the date of the next regularly scheduled municipal election of the town established pursuant to Section 2.32.010 of this chapter; provided, that: (a) the date of such special election shall not be less than one hundred fourteen days from the date of the call of such election by the town council; and (b) the town council need not call such a special election if the earliest election date for such a special election would be the next regular municipal election at which the term of the former incumbent would have expired.
