§ 12.24.010. Imposition and rate of development impact fees.

In order to offset the impact of future development and maintain current levels of service and corresponding infrastructure, the following fees are imposed for the types of development specified, pursuant to Government Code Sections 66000 et seq., unless otherwise specified. The rate of each fee (and the standard and formulas for setting the rate where required) shall be established by resolution.

A. Road Circulation/Major Roads. A road circulation/major road fee is imposed on residential, commercial and industrial developments, in order to defray the cost of improving traffic circulation and widening, extending and improving major roads, as new development occurs.

B. Horseshoe Bar Interchange. A Horseshoe Bar/I-80 Interchange fee is imposed on residential, commercial and industrial development, in order to defray the cost of widening, extending and improving this interchange, as new development occurs.

C. Sierra College Boulevard. A Sierra College Boulevard fee is imposed on residential, commercial and industrial development, in order to defray the cost of widening, extending and improving Sierra College Boulevard, as new development occurs.

D. Drainage. A drainage fee is imposed on residential, commercial and industrial development, in order to defray the cost of expanding the town drainage system, as new development occurs.

E. Community Facilities. A community facilities fee is imposed for residential, commercial and industrial development, in order to defray the cost of constructing community facilities, as new development occurs.

F. Parkland Dedication/In-lieu Fee. A parkland dedication/in-lieu fee requirement is imposed pursuant to and in accordance with Government Code Section 66477 on residential development, in order to allow the acquisition of land for town parks, as new development occurs.

G. Parkland Fee. A parkland fee is imposed on residential development not subject to the parkland fee imposed pursuant to Government Code Section 66477, and on commercial and industrial development, in order to allow the acquisition of land for town parks, as new development occurs.

H. Passive Park/Open Space Fee. A passive park/open space fee is imposed on residential, commercial and industrial development, to defray the cost of acquiring passive parkland and open space, as new development occurs.

I. Park Facilities. A park facilities fee is imposed on residential, commercial and industrial development, to defray the cost of constructing park facilities and other park improvements, as new development occurs.

§ 12.24.020. Time of collection.

The development impact fees imposed by this chapter shall be collected at the time of building permit issuance, unless otherwise required by law or agreed upon by the parties.

§ 12.24.030. Findings.

The resolutions establishing the rate of each fee shall contain findings concerning whether the fee constitutes a special tax, the relationship between the use of the fees and the types of development they are assessed for, the relationship between the need for the public facilities and infrastructure and the types of development on which the fees are imposed, the limitations on the use of the fees and the applicability of the California Environmental Quality Act.
