Chapter 8.40 — MOBILE FOOD FACILITIES

The City hereby incorporates by reference the provisions of the California Health and Safety Code, (California Health and Safety Code, § 113700 et seq.) The City's Health Department shall have

responsibility for ensuring that all mobile food facilities operating in the City comply with the provisions of the above referenced code. Mobile food facilities that are vehicles shall additionally comply with the applicable requirements in the California Vehicle Code and obtain an insignia from the California Department of Housing and Community Development. In the case of any conflicts between this chapter and state law, the state law provision shall control.

Editor's note— ORD-26-0011 § 2(Exh. B), adopted May 5, 2026, repealed the former Ch. 8.40, §§ 8.40.010—8.40.130, and enacted a new Ch. 8.40 as set out herein. The former Ch. 8.40 was entitled "Mobile Food Vending Vehicles," and derived from Prior code §§ 5510.22, 5510.24—5510.35.

8.40.010 - Construction.

Mobile Food Facilities, as defined in the California Health and Safety Code, including but not limited to catering trucks, ice cream trucks, produce trucks, pushcarts, and other similar mobile food units, shall submit plans and specifications for review and approval by the Department of Health and Human Services prior to construction, modification, or operation.

Plans shall demonstrate compliance with all applicable provisions of the State Code including requirements related to food preparation, equipment, sanitation, warewashing, potable water supply, wastewater disposal, commissary use, and safe food handling practices.

The permitting, licensing and operation of a Mobile Food Facility shall not commence until plan approval has been granted and a valid health permit has been issued by the Department of Health and Human Services.

8.40.020 - Inspection days.

All food facilities having a Health Department Permit to operate within the City shall report to the Department of Health and Human Services - Environmental Health Bureau by appointment twice each year during the second or third Tuesday of the month of February and August for the purpose of routine inspection. In the event of either day being a legal holiday, the next following day is designated. Failure to appear for inspection as described in this Section shall be deemed a violation of this Chapter and may be cause for revocation of permit to operate.
