Lompoc Municipal Code Ch. 5.76 Tear Gas Permits

A. The ordinance codified in this Section is adopted to comply with the requirements of Section 12403.7 and related sections of the California Penal Code.

B. Applications for the personal use of tear gas or a tear gas weapon for self-defense shall be made to the Police Department. Each application shall include a ten-dollar fee. The fee is not refundable in the event the permit is not issued.

C. The Chief of Police shall first determine whether or not the applicant meets the criteria for issuance of a permit under Section 12403.7 of the Penal Code and that the tear gas or tear gas weapon involved will be used pursuant to the Penal Code and any regulations of the use of tear gas or tear gas weapons issued by the Department of Justice. Upon making such a determination, the Chief of Police shall issue the permit. The permit shall be valid for the period of time indicated in said Penal Code section.

D. The Chief of Police may refuse to issue the permit or may revoke the permit upon any of the grounds allowed by said Section 12403.7 or regulations of the Department of Justice.
