Sec. 12-3.01. - Rules and regulations adopted.

The city council shall adopt by resolution rules and regulations governing the operation of the city's municipal water system including for disconnection and reconnection of service and costs and fees related thereto.

Sec. 12-3.02. - Unauthorized use of city water.

No person, company, corporation or other agency shall take water from the city's water system without first obtaining permission to take water from the city's engineer or authorized representative and making payment of applicable processing and water supply charges of the city. For purposes of enforcement of this section, no more than one violation per day per point of access to the city's water supply system will be deemed in violation of this section.

Sec. 12-3.03. - Citations.

The director of public works shall authorize designated city employees or the city's law enforcement officers who shall be authorized to issue citations to individuals violating any ordinance, rule or regulation of the city governing its water system. Such citation shall be personally served upon the person violating the regulations or ordinances of the city or upon any employee, agent or representative thereof, and shall specify the rule, regulation or ordinance violated, the dates of violation, the date of service of citation, the person issuing the citation, and the person receiving the citation.

Sec. 12-3.04. - Violation deemed an infraction.

Any violation of this chapter or of the rules and regulations established hereunder shall be deemed an infraction and shall be punishable by a fine of one hundred dollars ($100.00) for the first violation, two hundred dollars ($200.00) for a second violation within one year of the first violation, and five hundred dollars ($500.00) for each additional violation after the second violation which occurs within one year from the first violation.
