Sec. 6-5.01. - License fee; duration of license.

The fee for any license required by the business license law shall be that set forth in this chapter for the particular business involved. The fee and duration of the license shall be annual unless specifically designated otherwise.

Sec. 6-5.01.1. - Indexing.

Every tax imposed by this title VI shall be automatically adjusted on April 1 of each year. The adjustment shall be equal to the percentage difference between the Consumer Price Index for the Los Angeles/Long Beach Area as calculated by the Bureau of Labor Statistics for the December immediately preceding the April 1 on which the increase takes effect and the same index for the December of the preceding year. The formula for calculation shall be as follows:

A - B = C: - B × 100 = percentage difference

A = most recent December CPI B = prior December CPI C = index point change

Under no circumstances shall any adjustment be less than zero.

Sec. 6-5.02. - Businesses, professions and trades generally.

(a) Fee based on gross receipts. Businesses, professions, trades and occupations as defined in section 6-1.03 of the business license law, including contractors with a fixed commercial place of business within the city unless specifically provided otherwise in this chapter, shall procure a business license and pay a fee annually as follows:

(b) Multiple uses. Where the activities, business, occupation or calling conducted by a person under two (2) separate categories covered by this chapter, a license shall be obtained for each separate activity.

Sec. 6-5.02.1. - Principal solicitor's license fees.

Notwithstanding the foregoing or any other provisions of this title, the city clerk or an authorized deputy may issue a principal solicitor's license to every person either employing or contracting with one (1) or more individuals for solicitor's services as hereinbefore defined. If a principal solicitor should elect to use the provisions of this section, no principal solicitor's license shall be issued until the applicant files with the city clerk or an authorized deputy a list of all solicitors employed or retained by the applicant or with whom the applicant has a contract and unless the applicant executes an agreement that he will within five (5) days thereafter notify said city clerk in writing of every change in personnel of those so soliciting for him. In addition, no principal solicitor's license shall be issued until all regulatory provisions of the Business License law have been complied with. In such an event the application fee for a solicitor's permit shall be included within the principal solicitor's license fee, but each individual solicitor must obtain a permit in accordance with the terms and provisions of the business license law. Nothing herein contained shall be deemed to grant to a principal solicitor the privilege of soliciting unless there is maintained in full force and effect for each individual solicitor a permit in accordance with the terms and provisions of the Business license law. The license fee for a principal solicitor's license shall be three hundred twelve dollars ($312.00) annually plus eight dollars ($8.00) for each solicitor to whom a permit is issued.

The following businesses, professions, trades and occupations, because of their nature and circumstances, shall have a different license fee than that set forth in section 6-5.02. This fee shall be an annual fee unless otherwise specified herein.

Eighty-eight dollars ($88.00) annually for the first table; forty dollars ($40.00) per annum for each additional table.

Sec. 6-5.03.4. - Entertainment, burlesque.

Notwithstanding any other provision of this chapter to the contrary, the fee for an annual entertainment license, where the applicant has as part of the entertainment any striptease or burlesque show, shall be eight thousand nine hundred fifteen dollars ($8,915.00) per annum plus seventy-two cents ($0.72) per one thousand dollars ($1,000.00) of gross income.

Sec. 6-5.03.5. - Dance halls (public) and entertainment.

Any person in the business of maintaining or operating a public dance hall or entertainment business where no alcoholic beverages are served, as herein defined, shall pay a single license fee of two hundred sixty-nine dollars ($269.00) per annum plus seventy-two cents ($0.72) per one thousand dollars ($1,000.00) of gross income.

Sec. 6-5.03.6. - Deliveries.

Ninety dollars ($90.00) annually per vehicle. All types of deliveries, including pickup and delivery, whether wholesale or retail, of goods, liquids, materials, edibles, personal property of any nature, petroleum products and all other kinds and types of property where no fixed place of business exists within the city.

Sec. 6-5.03.9. - Vending and other coin-operated machines.

(a) Schedule for vending machines, music boxes, etc. Any person in the business of maintaining or operating any of the machines or devices described in subsection (b) shall pay an annual fee based on total gross receipts directly attributable to the operation of said machines and devices within the City of Lomita, pursuant to the following schedule:

(b) Applicability of subsection (a). Subsection (a) shall apply to the following:

(1) Vending machines: Merchandise and other coin- or token-operated vending machines owned by persons other than the proprietor of a Lomita business operating under a valid business license issued pursuant to this title.

(2) Music boxes, phonographs or other musical devices operated by coins or tokens.

(c) Schedule for amusement devices, games of skill, etc. Any person in the business of maintaining or operating any of the machines or devices described in subsection (d) shall pay an annual fee based on total gross receipts directly attributable to the operation of said machines and devices within the City of Lomita, pursuant to the following schedule:

(d) Applicability of subsection (c). Subsection (c) shall apply to the following:

(1) Amusement devices, coin-or token-operated.

(2) Machines, games of skill, coin- or token-operated.

(3) Video games, coin- or token-operated.

(e) Liability for payment of license fee and confiscation of unlicensed machines. Where a vending or coin-operated machine is subject to the licensing provisions of this section, any person owning or in possession of said machine or in possession of the premises upon which said machine is located shall be responsible for the licensing of said machine. No person shall keep or maintain upon his premises any vending or coin-operated machine for which no license or permit has been obtained and upon which no license or decal has been posted. Where the person in possession of the premises upon which an unlicensed vending or coin-operated machine is located refuses to obtain a license for the same on the basis that the machine is not owned or possessed by him, the city manager or his authorized deputy or agent shall remove said machine to the city hall and shall place the same in storage until claimed by the rightful owner thereof. Said machine shall be delivered to the rightful owner upon payment of moving, storage and accrued business license charges.

(f) Display of name, address and phone number on machine. All vending and other coin-operated machines located in the City of Lomita shall have prominently displayed on them, the name, address and phone number of the owner said machine.

Sec. 6-5.03.10. - Advertising by.

(a) Billboards: One hundred and thirty-four dollars ($134.00) for the first sign or structure per company, plus forty-five dollars ($45.00) per additional sign or structure annually.

(b) Distributing handbills: Two hundred sixty-nine dollars ($269.00) annually; one hundred thirty-four dollars ($134.00) quarterly; twenty-seven dollars ($27.00) daily.

(c) Posting: Two hundred sixty-nine dollars ($269.00) annually; one hundred thirty-four dollars ($134.00) quarterly; twenty-seven dollars ($27.00) daily.

Where trucks are in an open area other than within a building for more than forty-eight (48) hours and said trucks are not used in connection with a business conducted from such premises, but rather said premises are merely used for storage of said trucks, sixty-two dollars ($62.00) plus sixteen dollars ($16.00) per each truck or trailer stored in said open area.

(a) Business license fees for home occupations (except contractors), as defined in the Zoning Ordinance, shall be based on gross annual receipts as follows:
