§ 3-8-1 DEFINITIONS.

For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

AUTOMOBILE WRECKING ESTABLISHMENT. A place where used machinery or automobiles are dismantled and the usable parts thereof are offered for sale.

HOUSE WRECKING ESTABLISHMENT. A place where used lumber, used building materials and used plumbing or electrical equipment of the type recovered from dismantled houses or buildings are collected and kept or offered for sale.

JUNK BUSINESS. A place where pieces of old metal, paper, glass, rubber and other old materials commonly known as junk are collected and kept or offered for sale.

§ 3-8-2 COMPLIANCE WITH BUILDING CODE, EXCEPTION.

No automobile wrecking establishment, junk business or house wrecking establishment shall be conducted, carried on or maintained in the city unless the same is conducted, carried on or maintained in a building conforming to the requirements of the building code of the city for the zone or locality in which such building may be situated; provided, however, that any such business may be conducted, carried on or maintained upon a lot or plot of land where such lot or plot of land is entirely surrounded by a solid, tight fence or wall at least six feet in height.

§ 3-8-3 REQUIREMENTS WHERE BUSINESS CARRIED ON WITHIN FENCED OR WALLED AREA.

Any fence or wall used for the purpose referred to in § 3-8-2 must be painted with a fire retardant paint and shall not have more than one opening upon any public street, and each opening shall be not more than 12 feet in width and shall be equipped: with a substantial, solid, tight gate or door of the same height as such fence or wall, and the same shall be kept securely closed at all times when such business or establishment is not open for business. No more than one sign of any kind whatever shall be painted or placed upon such fence or wall fronting on any street. Such sign shall not exceed 40 feet in length.

§ 3-8-4 MAINTAINING ESTABLISHMENTS PARTLY IN BUILDING AND PARTLY UPON LOT OR PLOT OF LAND.

It is permissible to conduct, carry on or maintain any business or establishment partly in a building such as provided for in this chapter and partly upon a contiguous lot or plot of land; provided, that such contiguous lot or plot of land is enclosed by a fence or wall as provided in §§ 3-8-2 and 3-8-3 of this chapter.

§ 3-8-5 COMPLIANCE PREREQUISITE TO LICENSE.

No license or permit shall be granted or issued to any person to conduct, carry on or maintain in the city any of the businesses or establishments defined in § 3-8-1 of this chapter unless the same is conducted, carried on or maintained in or upon buildings or premises conforming to the requirements of §§ 3-8-2 through 3-8-4 of this chapter.

§ 3-8-6 OPERATING A BUSINESS WITHOUT COMPLIANCE A MISDEMEANOR.

The conducting, maintaining or carrying on in the city of any automobile wrecking establishment, junk business or house wrecking establishment without securing a license or permit therefor from the city, or in or upon a building or premises other than as required by this chapter is declared to be a misdemeanor and punishable as such.
