§ 8-4-1 WATER WELLS, HEALTH HAZARD.

The City Council hereby finds and determines that a public water supply system with ample clean and potable water is required for the health, safety and well being and fire protection of the inhabitants of the city; and water wells owned and operated by any person other than the city may have an adverse effect upon the city’s public water system by diminishing the amount of underground water available for the city’s water supply system and by increasing the possibility of contamination of underground water and thereby becoming a health hazard.

§ 8-4-2 NEW WELLS, RESTRICTIONS.

No person may drill, dig or install a water well within the city for any purpose whatsoever, save and except for the City Water Department.

§ 8-4-3 EXISTING WELLS, RESTRICTIONS.

No person owning or operating a water well within the city that was in existence at the effective date hereof may:

(A) Furnish water whether by sale or gift to any other person;

(B) Deepen, enlarge or increase the pump horsepower of any such water well; and

(C) Operate or maintain said well in such a manner as may result in the contamination of the underground water supply.

§ 8-4-4 PENALTY.

Any person violating any provision of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be punishable as provided in § 1-4-1 of this code. A separate offense shall be deemed committed for every day that any violation of this chapter shall continue or occur.
