7-7C-1: PURPOSE:¶
Pursuant to the authority of California Health And Safety Code section 5471, the city council finds and declares that there is a continuing need within the city to create and accumulate funds for the acquisition, construction, reconstruction and maintenance of the city's water and sewerage facilities, including main trunk, interceptor and outfall sewers, distribution mains and appurtenances associated therewith, and in addition, to finance the repayment of general obligation bonds and federal grants for prior construction of the existing water and sewerage treatment facilities. The city council also finds that these funds have been previously established and collected as water and sewer connection fees by the authority of resolution 7833 and that it is the intent of this article to repeal resolution 7833 and to continue to collect connection fees by virtue of the authority and procedure established in this article. 7-7C-2: SCOPE:¶
A. Applicable Area: The area to which this article shall apply includes each and every parcel within the city limits of the city as it presently exists, or as it may hereafter exist, and each and every parcel outside the city as provided for herein, except to the extent that a building permit is issued to owners of improved properties which are, at the time of application for building permit, already connected to the water and sewer system and have previously paid all connection fees.
B. Service Outside City; Public Facilities: Upon written application by a public agency with public facilities located outside the boundaries of the city, the city council hereby designates to the city manager the authority to negotiate the terms and conditions of an agreement with the public agency which will be subsequently considered by the city council to extend water service and/or supply to a particular public facility. In so doing, the city manager shall consider the benefit of the public facility to the citizens of Lemoore and consult with and obtain review and/or approval of any such agreement by the city engineer and/or city attorney as applicable. Any such agreement shall be subject to final approval and ratification by the city council before it becomes effective.
C. Service Outside City; Landowner, Developer, Or Commercial Business: Upon written application by a landowner, developer, or commercial business located outside the boundaries of the city, the city council hereby designates to the city manager the authority to negotiate the terms and conditions of an agreement with the landowner, developer, or commercial business which will be subsequently considered by the city council to extend water service and/or supply to a particular parcel, lot or other facility. In so doing, the city manager shall consider the benefit to the citizens of Lemoore and consult with and obtain review and/or approval of any such agreement by the city engineer and/or city attorney as applicable. Any such agreement shall be subject to final approval and ratification by the city council before it becomes effective. Additionally, such extended service and/or supply pursuant hereto is only authorized for land within the city's sphere of influence and must conform with all current city ordinances and standards, including the payment of any and all applicable fees and other charges, current laws, receive the appropriate approvals of other agencies as required by law, and include a provision whereby the property owner agrees not to object to or otherwise oppose the city's annexation of the property owner's property at a future date, should such an annexation occur. 7-7C-3: CONNECTION FEES ESTABLISHED:¶
A. Sewer Connection Fee: A sewer connection fee in the sum of five hundred dollars ($500.00) per residential equivalent, as determined by the city engineer, shall be paid by each person or entity applying for a building permit. The said connection fee shall be paid, in full, prior to the issuance of a building permit.
B. Water Connection Fee: A water connection fee in the sum of five hundred dollars ($500.00) per residential equivalent, as determined by the city engineer, shall be paid by each person or entity applying for the issuance of a building permit from the city. The said connection fee shall be paid, in full, prior to the issuance of a building permit. (Ord. 8614, 10-7-1986)
7-7C-4: DISPOSITION OF FUNDS:¶
All fees collected in accordance with this article shall be deposited in a separate capital improvement fund established for the purposes herein described. (Ord. 8614, 10-7-1986)
