6-4-1: APPLICATION AND INTERPRETATION:¶
A. Application Of Provisions: The provisions of this title prohibiting the stopping, standing or parking of a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with other traffic or in compliance with the directions of a police officer or official traffic control device.
B. Conflicts With Other Laws: The provisions of this title imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restricted provisions of the Vehicle Code or of the ordinances of this city prohibiting or limiting the standing or parking of vehicles in specified places or at specified times. 6-4-2: NO PARKING AREAS:¶
No operator of any vehicle shall stop, stand, park or leave standing such vehicle in any of the following places, except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or other authorized officer or traffic sign or signal:
A. On either side of any street between the projected property lines of any public walk, public steps, street or thoroughfare terminating at such street, when such area is indicated by an appropriate sign or by red paint upon the curb surface.
B. In any area where the city chief of police determines the parking or stopping of a vehicle should constitute a traffic hazard or would endanger life or property, when such area is indicated by an appropriate sign or by red paint upon the curb surface.
C. In any area established by resolution of the city council as a no parking area, when such area is indicated by an appropriate sign or by red paint upon the curb surface.
D. In any area where the parking or stopping of any vehicle would constitute a traffic hazard or would endanger life or property.
E. On any street or highway where the use of such street or highway, or a portion thereof, is necessary for the cleaning, repair or construction of the street or highway or the installation of underground utilities, or where the use of the street or highway, or any portion thereof, is necessary for the movement of equipment, articles or structures of unusual size, and the parking of such vehicle would prohibit or interfere with such use or movements; provided, that signs giving notice of such no parking are erected or placed at least twenty four (24) hours prior to the effective time of such no parking.
F. At any place within twenty feet (20') of a crosswalk at an intersection in the central traffic district or in any business district when such place is indicated by appropriate signs or by red paint upon the curb surface; except, that a bus may stop at a designated bus stop.
G. Within six feet (6') of the approach to any boulevard stop sign or traffic signal. (1975 Code §9-10.04)
6-4-3: METHOD OF PARKING:¶
A. Parallel Parking: Parallel parking on any of the streets or portions of streets established by a resolution of the council as parallel parking zones, when a sign or pavement marking is in place indicating such parallel parking. It shall be unlawful for the operator of any vehicle to park said vehicle except:
A vehicle may be stopped or parked parallel to and within eighteen inches (18") from the right side of said vehicle to the curb facing in the direction of traffic movement.
Said vehicle shall be parked entirely within the limits of space allotted to park vehicles as the space is indicated on pavement markings. No vehicle shall park on the turning space designated by a white "X" on the pavement. (1975 Code §9-11.04)
B. Diagonal Parking: Diagonal parking on any of the streets or portions of streets established by resolution of the city council as diagonal parking zones, when signs or pavement markings are in place indicating such diagonal parking. It shall be unlawful for the operator of any vehicle to park the said vehicle except:
At the angle of the curb indicated by signs or pavement markings allotting space to park vehicles and entirely within the limits of said allotted space.
With the right front wheel nearest to the curb and within six inches (6") of said curb.
The provisions of this subsection shall not apply when such vehicle is actually engaged in the process of loading or unloading passengers, freight or goods, in which event the provisions applicable in section 6-4-7 of this chapter shall be complied with. (1975 Code §9-11.05)
C. Parking Within Markings: When parking space markings are placed on the highway, subject to other more restrictive limitations, no vehicle shall be stopped, left standing or parked other than within a single space, unless the size or shape of such vehicle makes compliance impossible 1 . 6-4-4: GENERAL PARKING RESTRICTIONS:¶
A. One-Way Streets And Alleys:
All vehicles so parked or stopped in the alleys designated in subsection 6-3-4A1 of this title shall be parked or stopped facing in the proper direction for legal traffic thereon, and on the north side thereof. (1975 Code §9-5.05)
All vehicles so parked or stopped in the alley designated in subsection 6-3-4A2 of this title shall be parked or stopped facing in the proper direction for legal traffic thereon, and on the south side thereof. (1975 Code §9-5.06)
B. Fire Zone Number One:
- Parking In Alleys:
a. No person shall park or stop any vehicle for any purpose other than the loading or unloading of passengers or material in any alley within the limits of fire zone number one. (1975 Code §9-5.03)
No stop for the loading or unloading of passengers shall be more than three (3) minutes, nor for the loading or unloading of materials for more than thirty (30) minutes in any such alley. (1975 Code §9-5.04)
b. No vehicle shall be parked or stopped in such a manner as to obstruct the passage of any other vehicle in any alley within the limits of fire zone number one. (1975 Code §9-5.07)
- Parking Heavy Vehicles: No person shall stop, park or leave standing any vehicle of more than two (2) tons' capacity, whether attended or unattended, on any street, excepting alleys, within the limits of fire zone number one; excepting, that vehicles of more than two (2) tons' capacity may be stopped, parked or left standing for the purpose of loading or unloading merchandise between the hours of seven o'clock (7:00) A.M. and ten o'clock (10:00) A.M. of any day in zones designated for loading and unloading of merchandise by the chief of police for the city. C. All Night Parking: No person shall stop, stand or park their vehicles on any street designated by resolution of the city council as all night parking prohibited streets for any period of time between the hours of two o'clock (2:00) A.M. and six o'clock (6:00) A.M. of any day; provided, that this subsection shall not apply to a vehicle of any regularly licensed physician when actually engaged in making professional calls. D. Parkways: No person shall stop, stand or park a vehicle within any parkway. (1975 Code §9-10.01)
E. Parking Near Schools:
The city chief of police is hereby authorized to erect signs indicating that no parking upon that side of any street adjacent to any school property shall be permitted, when such parking would, in his opinion, interfere with traffic or create a hazardous situation.
When official signs are erected prohibiting parking upon that side of a street adjacent to any school property, no person shall park a vehicle in any such designated place. (1975 Code §9-10.09)
F. Parking Vehicles For Certain Purposes:
Storage: No person who owns or has possession, custody or control of any vehicle shall park such vehicle upon any street or alley for more than seventy two (72) consecutive hours in any thirty (30) day period.
Vehicles For Sale: No operator of any vehicle shall park said vehicle upon any street in this city for the principal purpose of advertising or displaying it for sale, unless authorized by a resolution of the city council.
Repairing Or Greasing Vehicles: No person shall construct or cause to be constructed, repair or cause to be repaired, grease or cause to be greased any vehicle or any part thereof upon any public street in this city. Temporary emergency repairs may be made upon a public street.
Washing Or Polishing Vehicles For A Fee: No person shall wash or cause to be washed, polish or cause to be polished any vehicle or any part thereof upon any public street in this city when a charge is made for such service. (Ord. 2003-11, 12-16-2003)
G. Parking Of Heavy Trucks Regulated:
It is unlawful to leave, park or allow to be parked any commercial vehicle exceeding a maximum gross weight of five (5) tons commonly described as a truck, truck and trailer, or tractor, whether attended or not attended, on any public street, or alley fronting on any property zoned as residential, or in a residential area within the city, except that such parking will be permitted along those truck routes as designated in section 6-3-12 of this title where such parking is not restricted by appropriate signage. Nothing within this section relating to the parking or standing of commercial vehicles in excess of five (5) tons in a residential area will be effective with respect to any commercial vehicle making pick ups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted streets for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon the restricted street for which a building permit has previously been obtained.
For residents conducting a permitted home occupation in a residential area, only one vehicle, no larger than a one ton truck, may be used by the occupant directly or indirectly in conjunction with the home occupation. (Ord. 2014-02, 7-1-2014)
H. Parking, Stopping Or Letting Vehicles Stand In Certain Zones And Areas:
Except for temporary loading and unloading purposes, no person shall park, stop, or let stand any vehicle on private property in any zone of the city in such a manner that any portion of the vehicle extends beyond the property line into the public right of way and obstructs or seriously impedes the view of the driver of any vehicle lawfully approaching an intersection or while said driver lawfully enters or leaves any driveway; provided, however, that this subsection H1 shall not apply to vehicles parked, stopped, or let stand in the private driveway of private property constituting a corner lot where the vehicle cannot reasonably be parked in the driveway without encroaching beyond the property line into the right of way.
No person shall store, park, or let stand any vehicle in any street or alley of the city in any residential district for a continuous period of more than seventy two (72) hours in any thirty (30) day period.
Notwithstanding the provisions of subsections H1 and H2 of this section, approval may be granted by the chief of police for the temporary parking of a vehicle on a residential public street immediately adjacent thereto for up to seven (7) additional days if requested by the resident and if the vehicle is owned by someone other than the resident and good cause is shown. Said approval shall be visibly displayed on the vehicle. (Ord. 2003-11, 12-16-2003)
6-4-5: TIME LIMIT PARKING:¶
A. Ten Minute Parking:
Green curb marking shall mean no standing or parking for a period of time longer than ten (10) minutes at any time between nine o'clock (9:00) A.M. and six o'clock (6:00) P.M on any day except Sundays and holidays.
When authorized signs, parking meters or curb markings have been determined by the city chief of police to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle adjacent to any such legible curb marking or sign or parking meter in violation thereof. (1975 Code §9-11.01)
B. One Hour Parking: When authorized signs, parking meters or curb markings have been determined by the city chief of police to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle between the hours of nine o'clock (9:00) A.M. and six o'clock (6:00) P.M. on any day except Sundays and holidays for a period of time longer than one hour. (1975 Code §9-11.02)
C. Two Hour Parking: When authorized signs, parking meters or curb markings have been determined by the city chief of police to be necessary and are in place giving notice thereof, no operator of any vehicle shall stop, stand or park said vehicle between the hours of eight o'clock (8:00) A.M. and six o'clock (6:00) P.M. of any day except Sundays and holidays for a period of time longer than two (2) hours. (1975 Code §9-11.03)
6-4-6: NO STOPPING ZONES:¶
The city chief of police shall designate as established no stopping zones by placing and maintaining appropriate signs indicating that stopping of vehicles is prohibited and indicating the hours and days when stopping is prohibited. During the hours and on the days designated on the signs, it shall be unlawful for the operator of any vehicle to stop said vehicle on any of the streets or parts of streets established by resolution of the council as no stopping areas. 6-4-7: STOPPING FOR LOADING OR UNLOADING:¶
A. Authority To Establish Loading Zones:
- The city chief of police is hereby authorized to determine and to mark loading zones and passenger loading as follows:
a. At any place in the central traffic district or in any business district.
b. Elsewhere in front of the entrance to any place of business or the front of any hall or place used for the purpose of public assembly.
In no event shall more than one-half (1/2) of the total curb length in any block be reserved for loading zone purposes.
Loading zones shall be indicated by yellow paint on top of all curbs of said zones, and passenger loading zones shall be indicated by white paint on top of all curbs of said zones 1 . (1975 Code §9-12.01)
B. Standing For Loading Or Unloading Only:
No person shall stop, stand or park a vehicle in any yellow loading zone for any purpose other than loading or unloading of passengers or materials for such time as is permitted in subsection 6-2-7A of this title.
No person shall stop, stand or park a vehicle in any passenger loading zone for any purpose other than the loading or unloading of passengers for such time as is specified in said subsection 6-2-7A of this title.
No person shall stop, stand or park a vehicle for any purpose other than the unloading or loading of persons or material in any alley. (1975 Code §9-12.03)
6-4-8: DESIGNATION OF RESTRICTED AND PROHIBITED PARKING PLACES:¶
The city chief of police is hereby authorized to maintain, by appropriate signs or by paint upon the curb surface, all no stopping zones, no parking areas and restricted parking areas as defined and described in this title. (1975 Code)
6-4-9: EMERGENCY PARKING SIGNS:¶
A. Whenever the city chief of police shall determine that an emergency traffic congestion is likely to result from the holding of a public or private assembly, gathering, funeral or function, or for other reasons, the city chief of police shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as the city chief of police shall erect during the times that such emergency signs are in place. Such signs shall remain in place only during the existence of such emergency and the city chief of police shall cause such signs to be removed promptly thereafter.
B. When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. (1975 Code §9-10.11)
6-4-10: PEDDLERS AND VENDORS:¶
A. Parking Restricted: Except as otherwise provided in this section, no person shall stand or park any vehicle, wagon or pushcart from which goods, wares, merchandise, fruits, vegetables or foodstuffs are sold, displayed, solicited or offered for sale or bartered or exchanged, or any lunch wagon or eating car or vehicle, on any portion of any street within this city; except, that such vehicles, wagons or pushcarts may stand or park only at the request of a bona fide purchaser for a period of not to exceed twenty (20) minutes at any one place. The provisions of this subsection shall not apply to persons delivering such articles upon order of, or by agreement with a customer from a store or other fixed place of business or distribution. B. Permit To Park Required:
Food Vendors 1 : No person shall park or stand on any street any lunch wagon, eating cart or vehicle or pushcart from which tamales, peanuts, popcorn, candy or other articles of food are sold or offered for sale without first obtaining written permission to do so from the city chief of police which shall designate the specific location in which such cart shall stand.
Vehicles For Hire: No person shall park or stand any vehicle or wagon used or intended to be used in the transportation of property for hire on any street while awaiting patronage for such vehicle or wagon without first obtaining a written permit to do so from the city chief of police which shall designate the specific location where such vehicle may stand. (1975 Code §9-10.10)
6-4-11: DISABLED COMMERCIAL VEHICLES:¶
Every motor truck having an unladen weight of four thousand (4,000) pounds or more, and every truck or tractor, irrespective of weight when operated upon any street or highway during darkness, shall be equipped with and carrying at least two (2) flares or two (2) warning lights or reflectors, which reflectors shall be of a type approved by the department of California highway patrol. When any vehicle above mentioned is disabled upon streets or highways within this city where there is insufficient street lighting to reveal the vehicle at a distance of two hundred feet (200') during darkness, a warning signal of the character indicated above shall be immediately placed at a distance of approximately one hundred feet (100') in advance of and one hundred feet (100') to the rear of such disabled vehicle by the driver thereof. The warning signal herein mentioned shall be displayed continuously during darkness while such vehicle remains disabled upon such street or highway. (1975 Code §9-10.12)
6-4-12: PARKING LOTS:¶
A. Use Of Public Parking Lots: The use of public parking lots of the city shall conform with the following:
The chief of police shall designate points of entry into and departure from and parking areas on such parking lots by appropriate signs or pavement markings. When such signs or markings are in place giving notice thereof, no person shall enter, park on or depart from said lots with any vehicle contrary to the directions and provisions of such signs.
No person shall operate, drive or park any vehicle in or upon any public parking lot within the city and owned or operated by the city after the hours when parking upon such lots is prohibited and signs posted showing the hours for said parking lots.
B. Private Off Street Parking Facilities:
Use Generally: No person shall operate, drive or park any vehicle upon any privately owned and maintained off street parking facilities that are generally held open for the use of the public for purposes of vehicular parking upon adoption of a resolution of the city council describing said off street parking facilities pursuant to section 21107.8 of the Vehicle Code and upon the posting of a notice required by said section. (Ord. 8201, 3-2-1982)
Parking Restrictions:
a. No person shall park any vehicle in or upon any privately owned and maintained off street parking facility in violation of the terms and conditions shown on signs posted thereon. Such signs shall be not less than seventeen inches by twenty two inches (17" x 22") in size with lettering not less than one inch (1") in height and shall specify:
(1) The limitations on or extent of allowed parking; and
(2) That the off street parking facility is subject to public traffic regulations and control.
b. Notwithstanding the provisions of subsection B2a of this section, this subsection B2 shall not apply to any off street parking facility unless:
(1) The signs required by subsection B2a of this section are posted on the property, and
(2) A resolution is adopted by the city council describing said off street parking facility after a public hearing thereon with at least ten (10) days' prior written notice to the owner and operator of the privately owned and maintained off street parking facility involved.
c. Before the owner or person in lawful possession of any private property may cause the removal of a vehicle parked on the property, California Vehicle Code section 22658 requires:
(1) Signs prohibiting public parking to be displayed in plain view at all entrances to the property; and
(2) The size of such signs to be specified by ordinance.
The size of such signs shall be not less than seventeen inches by twenty two inches (17" x 22") with lettering not less than one inch (1") in height. (Ord. 8403, 4-3-1984)
6-4-13: REMOVAL OF ILLEGALLY PARKED VEHICLES:¶
Any regularly employed and salaried officer of the police department of this city may remove or cause to be removed:
A. Any vehicle that has been parked or left standing upon a street or highway for seventy two (72) hours in any thirty (30) day period, or more consecutive hours, without approval of the chief of police.
B. Any vehicle which is parked or left standing upon a street or highway between the hours of seven o'clock (7:00) A.M. and seven o'clock (7:00) P.M. when such parking or standing is prohibited by ordinance or resolution of this city and signs are posted giving notice of such removal.
C. Any vehicle which is parked or left standing upon a street or highway where the use of such street or highway or a portion thereof is necessary for the cleaning, repair or construction of the street or highway or for the installation of underground utilities or where the use of the street or highway or any portion thereof is authorized for a purpose other than the normal flow of traffic or where the use of the street or highway or any portion thereof is necessary for the movement of equipment, articles or structures of unusual size and the parking of such vehicle would prohibit or interfere with such use or movement; provided, that signs giving notice that such vehicle may be removed are erected or placed at least twenty four (24) hours prior to the removal.
