3-8-1: PERMIT REQUIRED:¶
No person in any zone in the city shall sell or advertise in any manner whatever a sale of new or used merchandise at a garage, yard, patio or similar sale without obtaining a special permit from the building inspector and complying with the rules and regulations for same. (1975 Code §5-3.01)
3-8-2: RULES AND REGULATIONS APPLICABLE TO ALL SALES:¶
The provisions of this section shall apply to all such sales whether conducted by the owner, tenants, their agents, consignees or otherwise and/or by profit and nonprofit organizations. (1975 Code §5-3.04)
A. License Fee: The license fee for sales covered by this chapter shall be according to the city of Lemoore master user fee schedule. (Ord. 2014-03, 7-1-2014)
B. Term Of Sale: The maximum period of sale shall be three (3) days.
C. Number Of Sales Per Year: The maximum number of such sales at any one address shall be limited to two (2) per calendar year while the land is vested in the same ownership.
One additional individual or family may, without license, jointly participate with the licensee in the sales referred to in the above paragraph, provided the items offered for sale by such person or persons are as defined by section 3-8-3 of this chapter.
D. Enforcement:
The building inspector and police department shall enforce the provisions of this section and may establish other necessary rules and regulations pertaining to the sale affecting the public health and safety, and providing a reasonable area for public travel.
The police department shall have the right to order the withdrawal from sale of any items which do not comply with this section. (1975 Code §5-3.04)
3-8-3: RESTRICTIONS ON ITEMS SOLD:¶
No person shall sell or offer for sale personal property in any residential zone except personal property owned, utilized and maintained by such person or members of his family on or in connection with the premises which they occupy. Personal property offered for sale shall not be displayed in any sidewalk or public right of way. (1975 Code §5-3.02)
In the event miscellaneous items of personal property are to be offered for sale to the general public by means of a garage sale, patio sale or other sale similarly conducted, the person conducting such sale shall file an affidavit with the city clerk stating that all the property to be sold is his own personal property and has not been acquired or consigned to him for purposes of resale. (1975 Code §5-3.03)
3-8-4: ADVERTISING SIGNS:¶
No signs shall be posted in any place other than the property where the sale is being conducted. Said signs shall not exceed six (6) square feet in size. (1975 Code §5-3.05)
3-8-5: EXCEPTIONS TO PROVISIONS:¶
A. The above sections shall not apply to sales of personal property made under court order or process.
B. In the case of churches, public schools, fraternal organizations and other nonprofit entities, sales for charitable purposes may be conducted in other than single-family residential zones upon issuance of a permit. (1975 Code §5-3.06)
3-8-6: VIOLATION AND PENALTIES:¶
Any person violating any of the provisions of this chapter shall be guilty of an infraction and shall be punishable as set forth in sections 19(c) and 19(d) of the Penal Code of the state of California. (1975 Code §5-3.07)
