§ 5.12.010. Purpose and intent.

It is the purpose and intent of the city council, through the adoption of this chapter, to facilitate effective coordination with the department of alcoholic beverage control by providing a process for the review of applications for the issuance or transfer of alcoholic beverage licenses and for requests for a public convenience or necessity determination by the department of alcoholic beverage control.

§ 5.12.020. Coordination of review.

The city manager, or his or her designee, shall coordinate the review of applications for the issuance or transfer of alcoholic beverage licenses and requests for a public convenience or necessity determination within the city in accordance with Sections 5.12.030 and 5.12.040. The city manager, or his or her designee, shall serve as the primary liaison to the department of alcoholic beverage control.

§ 5.12.030. Review of applications.

A. Upon receiving an application for the issuance or transfer of an alcoholic beverage control license, the city manager, or his or her designee, shall route the application to the Los Angeles County sheriff's department, community development director, and finance department, or their designees, for review and comment. The city manager may also refer any application to any other appropriate person or body for comment.

B. If, based upon investigation and comments received from the Los Angeles County sheriff's department, community development director, and/or director of finance, or their designees, or such other person or body, where applicable, the city manager, or his or her designee, determines that the city should file a protest or propose conditions with respect to the issuance or transfer of a license, the city manager, or his or her designee, shall prepare and submit the protest or proposed conditions to the department of alcoholic beverage control within thirty days of the mailing of the notice and application by the department of alcoholic beverage control. The protest shall state the grounds for the protest and include such relevant information as has been obtained.

§ 5.12.040. Review of requests for a public convenience or necessity determination.

A. Upon receiving from the department of alcoholic beverage control a request for a determination that public convenience or necessity would be served by the issuance of the retail license pursuant to Business and Professions Code 23958.4(b)(2), the city manager, or his or her designee, shall route such request to the Los Angeles County sheriff's department, community development director, and finance department, or their designees, for review and comment. The city manager, or his or her designee, may also refer such a request to any other appropriate person or body for comment.

B. The city manager, or his or her designee, shall prepare and deliver a response to such a request based upon investigation and the comments received from the Los Angeles County sheriff's department, community development director, director of finance, and such other person or body, where applicable, to the department of alcoholic beverage control.
