5.32.010 Submission of Information by Applicant.¶
No license shall be issued covering any of the businesses, trades, callings or occupations included in this chapter until the applicant has furnished, in addition to the information required by Larkspur Municipal Code Section 5.16.010, such information as may be required by the Police Chief for the purpose of submitting to the Tax Collector a recommendation concerning issuance of the license applied for. 5.32.020 Investigation – Issuance – When Permit Required.¶
A. If, in the judgment of the Police Chief, the representations made in the statement, or their investigation of the applicant, disclose that the granting of the license applied for will not be detrimental to the public peace, morals, health, safety or general welfare, they shall so report to the Tax Collector and the license shall be issued.
B. If, however, the representations made in the statement or investigation of the applicant, disclose that the granting of the license applied for may be detrimental to the public peace, morals, health, safety or general welfare, or that the applicant is not of good moral character or has been convicted of any violation of law involving moral turpitude, they shall recommend to the Tax Collector that the license shall not be issued unless and until a permit therefor has been granted by the City Council.
C. The Tax Collector, in such instance, shall not issue the license; provided, however, that upon request of the applicant, the Tax Collector shall turn the entire matter over to the City Clerk to be handled in accordance with Larkspur Municipal Code Sections 5.34.020 and 5.34.030. 5.32.030 Street Vendors.¶
A. “Street vendor” means any person, whether or not having regularly established place of business, for the conducting of which a license is required pursuant to other provisions of this title, engaging in the business of vending, selling or offering for sale any goods, wares, or merchandise from any portable stand within the City.
B. The license fee is one hundred seventy-five dollars ($175.00) per year; or, at the option of the licensee, seven dollars and fifty cents ($7.50) per day for each person so engaged, with a minimum of twenty-five dollars ($25.00). (Ord. 1030 § 2(4), 2018; Ord. 583 § 6, 1977)
5.32.040 Handbill Distributors.¶
A. “Handbill distributor” means any person engaged in the business for hire or gain of distributing commercial or noncommercial handbills, other than newspapers, and any person receiving compensation directly or indirectly for the distribution of such handbill; provided that no license fee is charged for the distribution of any noncommercial handbill, the principal purpose of which is to disseminate information relating to any political, economic, religious, philosophical, sociological or related subjects and not connected with any commercial enterprise.
B. The license fee is one hundred seventy-five dollars ($175.00) per year; or, at the option of the licensee, seven dollars and fifty cents ($7.50) per day for each person so engaged. (Ord. 1030 § 2(4), 2018; Ord. 583 § 7, 1977; Ord. 265 § 72C (part), 1959)
5.32.050 Vehicular Street Advertising.¶
“Vehicular street advertising” means the business of advertising commercial enterprises of any character, or for any purpose, carried on by means of any vehicle traversing the public streets. (Ord. 1030 § 2(4), 2018; Ord. 583 § 8, 1977; Ord. 265 § 72C (part), 1959)
5.32.060 Taxicabs and Ambulance Service.¶
The license fee is forty-three dollars ($43.00) per vehicle, per year. (Ord. 1030 § 2(4), 2018; Ord. 583 § 10, 1977)
5.32.070 Klieg Lights.¶
The license fee is eighty-six dollars ($86.00) per year for each light; or, at the option of the licensee, seven dollars and fifty cents ($7.50) per day. (Ord. 1030 § 2(4), 2018; Ord. 583 § 11, 1977)
5.32.080 Auctioneers.¶
A. “Auctioneer” means any person not having a fixed place of business in the City engaged in selling at auction any real estate, goods, wares, materials, or merchandise, or any similar, kindred or related thing, for which a license fee is not specifically required under any other section of this title, providing that no additional fee is required of any person otherwise licensed to do business in the City personally carrying on an auction sale in the regular course of their business.
B. The license fee is two hundred eighty-three ($283.00) dollars per year; or, at the option of the licensee, twenty-one dollars ($21.00) per day. (Ord. 1062 § 14, 2022; Ord. 1030 § 2(4), 2018; Ord. 583 § 12, 1977; Ord. 265 § 72C (part), 1959)
5.32.090 Coin-Operated Vending Machines.¶
The license fee for coin-operated vending machines is as follows: a business license tax of thirty-five dollars ($35.00) plus:
Vending merchandise only:
When cost to operate is one cent ($0.01) – fifty cents ($0.50) per year per machine;
When cost to operate is two cents ($0.02) to nine cents ($0.09) – two dollars ($2.00) per year per machine;
When cost to operate is ten cents ($0.10) and over – five dollars ($5.00) per year per machine.
Amusements:
Music boxes and mechanical devices, including remote control machines operated from a central station – twelve dollars ($12.00) per year per machine. (Ord. 1030 § 2(4), 2018; Ord. 401 § 23, 1971; Ord. 265 § 72C (part), 1959)
5.32.100 Amusements.¶
A. An amusement license is required of any person engaged in the business of maintaining any amusement machine, apparatus or device designed or constructed for the purpose of producing or reproducing or playing any musical tone or tones or combination of tones, or any similar instrument, recording device, music box, jukebox, motion picture or photograph machine, or any other mechanical device displaying pictures or emitting music or furnishing entertainment for the amusement of the public, maintained for entertainment and amusement purposes only, and not contrary to any state law or City ordinance, and requiring for its operation the insertion of any coin, disk, plate, token, key or the payment of any fee therefor.
At the option of the licensee, coin-operated machines and amusements may be licensed under Larkspur Municipal Code Sections 5.24.020 through 5.24.060, classification B.
B. For music boxes and mechanical devices, including remote-control machines operated from a central station, the license fee is seventeen dollars and fifty cents ($17.50) per year per machine. (Ord. 1030 § 2(4), 2018; Ord. 583 § 12, 1977; Ord. 265 § 72C (part), 1959)
5.32.110 Fire/Burglar Alarm Installation.¶
The license fee is seventy-five dollars ($75.00) per year or, at the option of the licensee, twenty-five dollars ($25.00) per quarter. In addition to certification by the Police Chief, contractors installing fire alarm systems shall obtain a certification from the Fire Chief. (Ord. 1030 § 2(4), 2018; Ord. 583 § 13, 1977)
5.32.120 Delivery Services for Cannabis and Cannabis Related Products.¶
“Delivery services for cannabis and cannabis related products” means every person or cannabis-based business (commercial or nonprofit) not having a fixed place of business within the City who delivers cannabis goods, wares, or merchandise of any kind by any form of mechanized vehicle or by bicycle.
