11.06.010 - Assumption of responsibility.

The city of Lancaster ("city") assume responsibility for the enforcement of the Mobile Home Parks Act (the "Act") set forth in Division 13, Part 2.1 of the California Health and Safety Code (commencing with Section 18200) and related administrative regulations (the "Regulations") which are set forth in Title 25 of the California Code of Regulations, Section 1000 et seq.

11.06.020 - Delegation of authority.

Responsibility for enforcing the Act is delegated to the city's division of code enforcement of the department of housing and neighborhood revitalization (the "division").

11.06.030 - Enforcement personnel.

The division shall provide qualified personnel to enforce the Act. The city's housing and neighborhood revitalization director shall initially hire the following personnel to the enforcement program: one code enforcement officer and one administrative clerk. Additional personnel shall be assigned to the enforcement program as needed.

11.06.040 - Schedule of fees.

The schedule of fees contained in the act and regulations is adopted by the city.

11.06.050 - Statement of objectives.

The state program and objectives contained in the act and regulations are adopted by the city.

11.06.060 - Description of existing mobile home parks.

The existing mobile home parks in the city are described in Exhibit A attached hereto and incorporated herein by this reference. The occupancy and condition of mobile home parks cannot be substantiated until after the city has been granted approval by the department of housing and community development (the "HCD") to assume responsibility for enforcing the Act.

11.06.070 - Local objectives and program plan.

The specific objectives of the city in assuming responsibility from the HCD are to: (1) provide timely and reliable enforcement of the act and regulations, (2) maintain the condition of mobile home parks currently in compliance with the Act and upgrade the condition of mobile home parks which are not presently in compliance with the Act, and (3) promote the general health, safety, and welfare of the entire community. To achieve the foregoing objective, the following program plan shall be implemented within the time periods set forth below:

A. Review all relevant records maintained by HCD mobile home parks in the city and compare same with city's records within thirty (30) days of the effective date of assumption of enforcement by city;

B. Ascertain the status of all permits issued pursuant to the Act within thirty (30) days of the effective date of assumption of enforcement by city;

C. Contact appropriate parties to inspect all mobile home parks in the city and the mobile homes located thereon within one year of the effective date of assumption of enforcement by city;

D. Issue notices of violation and obtain compliance with the act and regulations within two years of the effective date of assumption of enforcement by city;

E. Initiate an annual inspection program within one year of the effective date of assumption of enforcement by city;

F. Investigate and resolve complaints filed with the administrative clerk on a continuous basis.

11.06.080 - Effective date of assumption of enforcement.

The effective date of assumption of enforcement responsibilities by the city shall be July 12, 2007.

11.06.090 - Transmittal of ordinance.

The city clerk is authorized and directed to transmit two certified copies of the ordinance codified in this chapter to the administrative office of the division of codes and standards immediately upon adoption of the ordinance codified in this chapter.

11.06.100 - Inspection capability.

The capability of the division to perform mobile home installation inspections to the satisfaction of the HCD is demonstrated as follows:

A. The division has established and operated code enforcement programs since 1978 including, but not limited to, enforcement of this code, building enforcement programs including, but not limited to, enforcement of the State Uniform Building Code, Uniform Housing Code, Uniform Plumbing Code, Uniform Mechanical Code and the National Electrical Code;

B. The city of Lancaster has effectively assumed responsibility for the enforcement of the Mobile Home Parks Act for a total of nine years, establishing and operating code enforcement programs including, but not limited to, enforcement of this code, building enforcement programs including, but not limited to, enforcement of the State Uniform Building Code, Uniform Housing Code, Uniform Plumbing Code, Uniform Mechanical Code and the National Electrical Code.

11.06.110 - Forms.

The city shall use the following forms provided by HCD to enforce the Act: (1) the application for permit to operate, (2) the permit to operate, and (3) the statement of acceptance.

11.06.120 - Permits to operate.

The city agrees to send a copy of all permits to operate to the administrative office of the division of codes and standards not later than the fifteenth of the month following the city's issuance of such permits.

11.06.130 - Appeals procedure.

Decisions of the division made pursuant to this chapter may be appealed by any applicant in accordance with the Uniform Appeal Procedure set forth in Chapter 2.44 of this code. Failure of the city clerk to receive a timely appeal constitutes a waiver of the right to contest the decision.

11.06.140 - Fair housing.

Mobile home operators shall comply with federal fair housing laws and grant persons with disabilities the ability to make reasonable accommodation requests for equal opportunity use and enjoyment of a dwelling. The mobile home operator shall not refuse residency to persons with disabilities, or place conditions on their residency, on the basis of those persons requiring reasonable accommodation.
