10.24.010 - License required.

A person, firm or corporation shall not operate or permit to be operated on any highway in the city any bicycle propelled wholly or in part by muscular power, the owner of which bicycle is a resident of the city unless and until such bicycle is registered with the sheriff and licensed, and the license is attached to the bicycle as provided in this chapter.

10.24.020 - Application for license.

The applicant for the registration and licensing of a bicycle shall make application therefor, accompanied by a fee of seventy-five cents ($0.75), upon forms provided for by that officer. Such form shall show:

A. The name and address of the applicant;

B. A description of the bicycle to be registered and licensed including the serial number of the bicycle, if any, make of the bicycle, type of bicycle, model of bicycle and the color thereof;

C. Such other information or description as the sheriff may require.

10.24.030 - Issuance of registration and license.

Upon receipt of an application in full compliance with Section 10.24.020 plus the fee of seventy-five cents ($.75), the sheriff shall:

A. Register the bicycle in a permanent register maintained by him;

B. Issue to the applicant a registration certificate;

C. Issue to the applicant a license plate or other indicia in the form designated by the Director of the Department of Motor Vehicles;

D. Attach to the frame of the bicycle the license indicia.

Both the registration certificate and the license bear the registration number assigned.

10.24.040 - Destruction of license or registration numbers prohibited.

A person, firm or corporation shall not wilfully remove, destroy, mutilate or alter, or cause or permit to be removed, destroyed, mutilated or altered, the number on any bicycle frame for which any such registration shall have been made pursuant to the provisions of this chapter.

A person, firm or corporation shall not remove, destroy, mutilate or alter, or cause or permit to be removed, destroyed, mutilated or altered, any license indicia issued pursuant to this chapter for any such bicycle or registration certificate relating to such bicycle during the time in which such license indicia or registration certificate is operative. Provided, however, that nothing in this chapter shall be deemed or construed to prohibit the sheriff from stamping any number on any such bicycle for identification purposes.

10.24.050 - Tax collector to provide license indicia.

The tax collector shall provide the sheriff for each bicycle licensed pursuant to the provisions of this chapter, a license indicia distributed to the city by the Department of Motor Vehicles.

10.24.060 - Transfer of license to another bicycle not permitted.

A person, firm or corporation shall not cause or permit to be transferred any bicycle license indicia issued pursuant to this chapter to any bicycle for which the same was not issued.

10.24.070 - Sale of bicycle—Notification of sheriff—License transfer to new owner.

Any person, firm or corporation who is the owner of a bicycle, whether licensed pursuant to the provisions of this chapter or unlicensed, who sells or otherwise disposes of a bicycle, except a new bicycle or new bicycle frame, whether in the course of business or otherwise, shall within ten (10) days thereafter:

A. Notify the sheriff of such disposition and inform him of:

  1. The name and address of the owner;

  2. The name and address of the transferee;

  3. A description of the bicycle including the serial number of the bicycle, make of bicycle, type of bicycle, model of bicycle, color of bicycle and the license number thereof, if any, or if no such license indicia is attached or the number is illegible, a statement of such fact.

B. If a registration card has been issued to the owner, he shall return such registration card to the sheriff. Any person who purchases or otherwise acquires possession of a bicycle shall within ten (10) days of taking possession apply for the transfer of license to his name as provided for in this chapter.

10.24.080 - License lost or stolen—Re-registration.

If the license indicia is lost, stolen or mutilated, the person, firm or corporation owning such bicycle shall make an application to re-register such bicycle. The applicant shall pay a fee of seventy-five cents ($.75) and procure from the sheriff a new license indicia. The sheriff shall cancel the registration of such bicycle in the permanent register, shall re-register such bicycle, and, if necessary, give to such bicycle a new identifying number.

10.24.090 - Renewal of license and registration.

Bicycle licenses shall be renewed uniformly at periods designated by the Director of the Department of Motor Vehicles pursuant to Vehicle Code Section 39001.

10.24.100 - Compliance with Vehicle Code.

The regulations in this chapter are in addition to those in Division 16.7 (commencing with Section 39000) of the Vehicle Code. This chapter shall be construed consistently with the provision of the Division.

10.24.110 - Secondhand dealers and wreckers required to report on bicycles.

Every auctioneer, auto wrecker, foundry, pawn broker, secondhand dealer, junk dealer or bicycle dealer shall notify the sheriff in writing on forms prescribed by the sheriff, not less often than once a week of every bicycle received in the course of business by him since his last report. In such reports he shall describe each such bicycle and give the license number thereof, if any. In addition he shall supply such other information as the sheriff shall require.

A. Waiting Time Before Sale of Bicycle. An auctioneer, auto wrecker, foundry, pawn broker, secondhand dealer, junk dealer or bicycle dealer receiving any bicycle in the course of business, shall not sell, transfer, deliver, destroy or alter any such bicycle until fourteen (14) days after its receipt has been reported to the sheriff.

10.24.120 - Violation—Penalty.

Any violation of any of the provisions of this chapter by any person, firm or corporation shall be punishable by a fine of not more than five dollars.
