1.08.010 - Code enforcement.

A. Authority to Arrest. Pursuant to Penal Code Section 836.5, a public officer or employee shall be authorized to make arrests without a warrant, whenever the public officer or employee has reasonable cause to believe that the person to be arrested has committed a violation in his or her presence of any ordinance of the city of Lancaster which the public officer or employee has the duty to enforce.

B. Authority to Arrest for Infractions and Misdemeanors. Public officers or employees shall be authorized to make an arrest for the violation of any provisions of this code, regardless of whether the violation constitutes an infraction or a misdemeanor.

C. Authority to Issue Notice to Appear. In any case in which a person is arrested pursuant to subsection A of this section and the person arrested does not demand to be taken before a magistrate, the public office or employee making the arrest shall prepare a written notice to appear and release the person on his promise to appear in accordance with Penal Code Section 853.6 et seq. as it currently exists and may be amended.

1.08.020 - Procedures and rules governing issuance of citations.

The city manager shall designate in writing those persons who are deemed to be public officers and employees for purposes of Section 1.08.010, and shall be authorized to establish rules and procedures governing the conduct of public officers and employees in the exercise of their duties to enforce the Lancaster Municipal Code.
