§ 8.30.080. Grading plan check deposit.

Before accepting a grading permit application and plans and specifications for checking, the City Engineer shall collect a plan-checking deposit in an amount established by resolution of the City Council. The cost to the City to process the application shall be charged against the deposit amount.

§ 8.30.082. Grading permit deposit.

A. A deposit for each grading permit shall be paid to the City Engineer prior to issuance of a grading permit. The amount of the deposit shall be established by resolution of the City Council and as provided in subarticle 6 of the grading manual. The cost to the City to process the application shall be charged against the deposit amount.

B. Failure to pay the deposit and obtain a permit before commencing work shall be deemed a violation of this Grading Code, except when it can be proven to the satisfaction of the City Engineer that an emergency existed which made it impractical to first obtain the permit. A violation shall result in an assessment of a penalty fee in an amount established by resolution of the City Council. Payment of a penalty fee shall not relieve any person from fully complying with the requirements of this Grading Code nor from any other penalties prescribed herein.

§ 8.30.084. Cost recovery fees.

If the City Engineer performs emergency work on private property, he/she shall charge the property owner all direct and indirect costs which are necessary to complete the work to his/her satisfaction. In addition, the City Engineer may charge a mobilization cost equal to 10% of the cost for performing the work.

§ 8.30.086. Refund of deposit.

The City Engineer shall refund the balance in a deposit account after deducting the costs incurred for processing the application after approval of the application and the completion of staff work on the associated permit.
