§ 3.26.010. Building Code fees.

It is the policy of the City to recover the costs for providing building inspections and other services pertaining to buildings. Therefore, all persons seeking such services within the City shall make the deposits and pay the fees adopted by resolution by the City Council. Said fees shall not exceed the costs to provide the services.

It is the policy of the City to recover the costs for providing planning services. Therefore, all persons seeking planning services within the City shall make the deposits and pay the fees adopted by resolution by the City Council. Said fees shall not exceed the costs to provide the services.

§ 3.26.030. Engineering fees.

It is the policy of the City to recover the costs for providing engineering services. Therefore, all persons seeking engineering services within the City shall make the deposits and pay the fees adopted by resolution by the City Council. § 3.26.040. Park/facility reservation fees.

It is the policy of the City to recover the costs for providing park/facility reservation services. Therefore, all persons seeking park/facility reservation services within the City shall make the deposits and pay the fees adopted by resolution by the City Council. Said fees shall not exceed the costs to provide the services.

§ 3.26.050. Miscellaneous fees.

It is the policy of the City to recover the costs for providing certain miscellaneous services, e.g., providing photo copies of various requested documents and maps. Therefore, all persons seeking such services within the City shall make the deposits and pay the fees adopted by resolution by the City Council. Said fees shall not exceed the costs to provide the services.

§ 3.26.070. Waiver of user fees and deposits—Public benefit.

Any user fee, deposit or permit fee required by the provisions of this chapter, or other provisions of this chapter which require the payment of a user fee, deposit or permit fee, may be waived in accordance with the procedures outlined in this section. Applicants for fee waivers must be local charitable, nonprofit, community, civic, youth or senior citizen organizations. Private, commercial organizations shall not be eligible for fee waivers. Notwithstanding the foregoing, waiver of park/facility user fees and deposits provided in Section 3.26.040 shall be governed by Section 13.02.033.

A. Organizations desiring a fee waiver shall submit a letter which identifies the organization, the specific fees sought to be waived, the estimated cost of the fees, and a justification and public benefit provided by the organization justifying the waiver of the fees.

B. Request for fee waivers may be approved by the appropriate department head if the amount of fee does not exceed $2,500 in any fiscal year. To approve a fee waiver, the department head shall make a written determination that the public benefit provided by the organization is equal to or exceeds the amount of the fees requested to be waived.

C. Fee waivers exceeding subsection B of this section but not exceeding $5,000 in any fiscal year may be approved by the City Manager. To approve a fee waiver, the City Manager shall make a written determination that the public benefit provided by the organization is equal to or exceeds the amount of the fees requested to be waived.

D. If the amount of the requested fee waiver in any fiscal year exceeds $5,001 as set forth in subsections B and C of this section, the request for fee waiver shall be presented to the City Council for consideration. In acting on the fee waiver request, the City Council shall determine that the public benefit provided by the organization exceeds the amount of the requested fee waiver.
