Sec. 15-44. - Restricted County Property.¶
44.2 Prohibited Activities.¶
It shall be unlawful for any person to ride or utilize a bicycle, skateboard, scooter, roller skates, in-line skates, and/or roller blades, on the following County properties:
(a) All pedestrian areas immediately adjacent to the Lake County Courthouse located at 255 North Forbes Street, in Lakeport, California. Unless otherwise prohibited by the City of Lakeport, this prohibition does not apply to the City-maintained sidewalks surrounding the Lake County Courthouse.
(b) The surface of the Upper Lake Tennis Court located at 575 East Hwy #20, Upper Lake, California, inclusive of the entire area inside the fence that encompasses the Tennis Court.
(c) The surface of the Middletown Tennis Court located at 20962 Big Canyon Rd., Middletown, California, inclusive of the entire area inside the fence that encompasses the Tennis Court.
(d) Within twenty (20) feet of the Middletown Senior Center and Library located at 21256 Washington Street, Middletown, California.
(e) The parking lot adjacent to the Middletown Senior Center and Library located at 21256 Washington Street, Middletown, California, when one (1) or more vehicles are parked therein.
(f) On any stairs, ramps, and railings at the Historic Lucerne Hotel located at 3700 Country Club Dr., Lucerne, California.
(g) All County maintained picnic tables, brickwork, cobblestones, fountain areas, planters, sculptures, and ornamental surfaces that are located in on any County property including but not limited any County park.
44.4 Authorized Activities.¶
As to all County property not specified in Section 15-44.2, it shall be lawful to ride or utilize bicycles, skateboards, roller skates, in-line skates, and/or roller blades subject to the following restrictions:
(a) All persons engaged in riding or utilizing bicycles, skateboards, scooters, roller skates, in-line skates, and/or roller blades shall yield to pedestrians at all times; and
(b) All persons engaged in riding or utilizing bicycles, skateboards, scooters, roller skates, in-line skates, and/or roller blades shall obey all traffic laws; and
(c) No person engaged in riding or utilizing bicycles, skateboards, scooters, roller skates, in-line skates, and/or roller blades shall do in a manner that creates a nuisance. For purposes of this section, "nuisance" is defined as any activity which:
Threatens injury to any person or property, public or private;
Creates an obstruction or presents a hazard to the free and unrestricted use of public or private property by pedestrians or motorists; or
Generates loud and/or unreasonable noise.
44.5 Kelseyville Skate Park Rules and Regulations.¶
a. Purpose. The purpose of this Section is to establish regulations for the safe use of the Kelseyville Skate Park.
b. Liability. The use of any skateboard or other "wheeled recreational device" as that term is defined by Health and Safety Code section 115800 at the Kelseyville Skate Park is a hazardous activity within the meaning of Government Code section 831.7. Subject to the provisions of this code section, the County of Lake may not be held liable for an injury incurred by any person in any such hazardous recreational activity. The Kelseyville Skate Park is not supervised on a regular basis and all users of this facility assume all risks of injury in using said facility.
c. Hours of Operation. The hours of operation of the Kelseyville Skate Park shall be from sunrise to sunset.
d. Safety Equipment Required. Persons riding a skateboard or other wheeled recreational device are required to wear a helmet, elbow pads, and knee pads.
e. Minimum Age. Users of the Kelseyville Skate Park must be twelve (12) years of age or older.
f. Food and Beverages. Food and beverages are prohibited on the skating surface. For purposes of this code section, "skating surface" is that area where the use of a skateboard or other wheeled recreational device is used and includes the concrete pad and obstacles.
g. Obstacles and Other Materials Prohibited. Additional obstacles or other materials, including but not limited to ramps and jumps, may not be placed in the Kelseyville Skateboard Park.
h. Motorized Vehicle Prohibition. Motorized vehicles are prohibited in the Kelseyville Skate Park.
i. No person shall ride a skateboard or other wheeled recreational device in the Kelseyville Skate Park in a reckless manner or with willful disregard for the safety of persons and property.
j. Except as otherwise expressly stated herein, all regulations applicable to all County parks shall apply to the Kelseyville Skate Park.
k. Signage. So to provide reasonable notice to the public, signs referring to this code section shall be posted in one (1) or more conspicuous areas at or near the entrance to the Kelseyville Skateboard Park, setting forth the rules and regulations established herein, including prohibited activities and the possible penalties for failure to comply with said regulations.
44.6 Penalties. Any person who violates any provision of Section 15-44 is guilty of an infraction, punishable by a fine as specified in Government Code section 25132. In addition, the operation of a bicycle, skateboard, scooter, roller skates, in-line skates, and/or roller blades as prohibited by Section 15-44 is declared to be public nuisance which may be summarily abated by a peace officer and/or an enforcement official as defined in Chapter 13 by impounding the skateboard, scooter, roller skates, in-line skates and/or roller blades used in the offense. Any items impounded under Section 15-44 shall be held for disposition as may be ordered by the court which hears and disposes of the infraction charge against the offender or by any court of competent jurisdiction.
44.8 Exemption from the Provisions of this Section.¶
Any device designated, intended, and used solely for the transportation of infants, disabled or incapacitated persons, devices designed, intended, and use for the transportation of merchandise to and from the place of purchase and other wheeled devices, when being used for either of these purposes shall be exempt from this section.
