Sec. 13-40. - Computation of Costs.

40.4 Attorney's Fees.

In any action, administrative proceeding or special proceeding to civilly abate a nuisance, attorney's fees may be recovered by the prevailing party. Recovery of attorney's fees by the prevailing party is limited to those actions or proceedings in which the County elects, at the initiation of that individual action or proceeding, to seek recovery of its own attorney's fees. In no action, administrative proceeding, or special proceeding shall an award of attorney's fees to a prevailing party exceed the amount of reasonable attorney's fees incurred by the County in the action or proceeding.

Sec. 13-43. - Liens and Collections.

43.1 Notice of Lien.

Upon confirmation by the Board, the Enforcement Official shall cause to be prepared and recorded in the office of the County Recorder of the County of Lake, a Notice of Lien. Said Notice shall contain the following:

a. An address, legal description or other description sufficient to identify the premises.

b. A description of the proceeding under which the special assessment was made including the order of the Board confirming the assessment.

c. The amount of the assessment.

d. A claim of lien upon the described premises.

43.5 Collection.

Alternatively, the Board of Supervisors may direct the Enforcement Official to prepare and issue a statement of abatement costs. If payment of the amount demanded in the statement of abatement costs is not received within thirty (30) days, the Enforcement Official shall refer the debt to a collection agency licensed by the State of California in accordance with California Government Code Section 26220(a), and as may be amended.
