Sec. 11-23. - Permit required; term; fee.

It shall be unlawful for any person or firm to carry on or engage in the business of the cleaning of septic tanks, chemical toilets, cesspools or seepage pits, or to dispose of the cleanings therefrom in the unincorporated areas of the County of Lake, State of California, unless he or it shall hold an unrevoked, current "Permit to Operate" issued by the Lake County Health Department.

(a) Permits shall be only for the unexpired portion of the calendar year in which application is made, and at the end of the calendar year all permits shall become void and of no effect.

(1) For purposes of this Ordinance permits issued or renewed prior to January thirty-first of any year shall be considered as having been issued on January first of that year.

(b) Application for permit to operate shall be made to the Lake County Health Department on forms furnished by the Lake County Health Department. Application shall state the name in full, if a partnership then names of each of the partners, the relation of the applicant to the firm or partnership, the place of business and place of residence of the applicant for the permit and of each of the partners in the business, if a partnership, and shall state the make, model, registration number and tank capacity of each vehicle to be used in the business, together with such other information as the Lake County Health Department may from time to time require. The application shall be signed by an authorized officer of a corporation, if a corporation; or by the managing partner, if a partnership.

(c) Each application for permit shall be accompanied by a permit fee in the amount of twenty-four dollars ($24.00).

(1) Permit fees for new permits issued after January thirty-first of any year shall be determined on the basis of one-twelfth of the total permit fee for each month remaining in the year beginning with the first day of the month in which application is made.

(d) Change of address of any permittee, including a member of a partnership which is registered, and of the place of business thereof, or any change or addition of vehicle used in the business shall be reported in writing by registered mail to the Lake County Health Department by the permittee within two (2) days after said change of address or change or addition of vehicle.

Sec. 11-24. - Inspection of vehicle.

Prior to issuance or renewal of any permit to operate, all pumping vehicles to be used in the business shall be brought to an office of the Lake County Health Department for inspection, and issuance or renewal of permit shall be dependent upon satisfactory condition of the vehicle and/or equipment used.

(a) Each pumping vehicle shall clearly display on each exterior side, in letters at least five (5) inches high, the name or firm name of the permittee and the Lake County registration number.

(b) All pumping vehicles shall be maintained at all times in satisfactory operating condition, shall be free of leaks and shall be maintained in a clean and sanitary condition. Hoses shall be free of leaks or breaks.

(c) Presence in, or accessibility from, the operator's compartment of any pumping vehicle of any mechanism or device regulating the discharge of sewage from a tank shall be deemed grounds for immediate permit denial or revocation.

Sec. 11-25. - Statements of service rendered.

Each permittee shall file with the Lake County Health Department by the tenth day of each month a statement giving the name and address of the owner or tenant of each and every one of the premises where a septic tank, cesspool or sewage seepage pit has been cleaned by the permittee or his employees or by others on his behalf during the previous month and the place where the cleanings have been disposed of and by whom. Statement shall be made on forms provided by the Lake County Health Department. Firms renting and servicing chemical toilets shall file monthly statements setting forth the location of each chemical toilet installed, the frequency with which it is serviced, the place where the cleanings have been disposed of and by whom. Said statement to be filed by the tenth day of each month for the preceding month.

Sec. 11-26. - Disposal of cleanings.

Subsequent to the effective date of this Article no septic tank, chemical toilet, cesspool or seepage pit cleanings shall be disposed of at any point in the unincorporated areas of the County of Lake other than at sewage treatment plants designated by the Special Districts Administrator and approved by the Lake County Health Officer.

(a) Fees for the disposal of septic tank, chemical toilet, cesspool or seepage pit cleanings shall be paid to the Lake County Sanitation District at the time and in the manner prescribed by the Lake County Special Districts Administrator. Said funds to be deposited in the appropriate sewer district fund.

(b) The fee for the disposal of septic tank, chemical toilet, cesspool or seepage pit cleanings at County Sewage Treatment Plants shall be determined as follows:

(1) One cent (1¢) per gallon of actual volume as determined by a meter or other device approved by the Lake County Special Districts Administrator, or

(2) A minimum fee determined as one cent (1¢) times the registered tank capacity (gallons) of the pumping vehicle.

Sec. 11-27. - Revocation of permit.

Any permit issued under this Article may be revoked by the Lake County Health Department for cause on ten (10) days notice to applicant, which notice shall be served by registered mail or in person at the latest place of residence or of business reported by the applicant.

Sec. 11-28. - Violation; penalty.

Violation of any of the provisions of this Article or of any order or orders of the Lake County Health Department or Special Districts Administrator made pursuant to this Article for the protection of human health and comfort shall constitute a misdemeanor, punishable by a fine of not more than five hundred dollars ($500.00) for each offense or by imprisonment for not more than thirty (30) days or by both such fine and imprisonment.
