Sec. 13-1-1. - Applicability of division.

This division shall, unless otherwise expressly provided, apply in all parks, beaches, recreational areas and other publicly owned or operated lands or waters falling within the definition of those terms as set forth in section 13-1-2. However, the application of this division may be expressly negated by ordinance or resolution of the city council.

Sec. 13-1-2. - Definitions.

The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Alcoholic beverage means alcohol, spirits, liquor, wine, beer and every liquid or solid containing one-half of one percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed or combined with other substances.

Beach means all public land owned by the city with water frontage and designed primarily to provide swimming, boating, fishing and other waterfront activities.

City means the City of Laguna Niguel and the Laguna Niguel Community Services District.

Eviction means revocation of the user's permit and expulsion from the facility.

Manager means the manager of parks and recreation for the city.

Park means every park, roadside rest, golf course, reservoir, riding and hiking trail, city service area greenbelt and city service area recreational facility, and every other public recreation facility owned, managed or controlled by the city.

Park waters means any lake, reservoir, pond, river or other body of water within or flowing through a park.

Person means every person, firm, corporation, copartnership, joint venture, association, social club or fraternal organization, or any other group or combination acting as a unit.

Recreational area means all parks, park waters and beaches.

Sec. 13-1-3. - Use of recreational areas; enforcement of division.

(a) The privilege of any person to use the recreational areas is hereby expressly conditioned upon compliance by that person with the provisions of this division as they apply to such use.

(b) In addition to other penalties provided for in this Code, violation of any provision of this division shall subject the violator to eviction from the park in which the violation occurs, and other parks if deemed necessary, all in accordance with the procedures in section 13-1-20. This division shall be enforced by the manager and such of his agents as he may designate to perform such duty, as well as by peace officers having jurisdiction of any area in which a violation of any provision of this division may take place.

Sec. 13-1-4. - Management of recreational areas.

The purpose of this division is to provide for the orderly administration and control of recreational areas within the city. The manager is hereby instructed to administer this division in such a way as to achieve the maximum benefit to the public.
