Sec. 9-1-1. - Establishment of planning commission.

There is hereby created a city planning commission consisting of five members. Members shall be appointed in accordance with the procedures set forth in title 2, division 3, of this Code. The city attorney, city director of community development, city engineer and the city traffic engineer are advisory members to the city planning commission. Advisory members shall not have the right to vote on any matter before the commission. The director of community development or his designee shall act as the executive officer to the commission. Advisory members may designate a deputy to sit with the commission in their absence. The provisions of title 2, division 3, shall be applicable to the planning commission, except when there is a conflict between the provisions of title 2, division 3, and the provisions of this article, in which case the provisions of this article shall prevail.

Sec. 9-1-2. - Terms of office of members of planning commission.

The term of office for members of the planning commission shall be two years, except that the initial term of office for three of the members of the commission shall expire on December 31, 1991, and the initial term of office for the other two members of the commission shall expire on December 31, 1992.

Sec. 9-1-3. - Meetings of planning commission.

The planning commission shall meet regularly at least once each month, at a time and place to be fixed by resolution of the city council, and it shall hold such other meetings as it deems necessary.

Sec. 9-1-4. - Compensation and expenses of members of planning commission.

Each member of the planning commission shall receive compensation as established by the city council and be paid his actual and necessary traveling expenses while conducting business for the commission.

Sec. 9-1-5. - Powers of planning commission.

In addition to those powers otherwise provided by law, the planning commission shall have the following powers:

(1)

The commission shall have the power to recommend to the officers of the city adoption of plans and regulations for the future growth, development and beautification of the city with respect to public and private development.

(2)

The commission shall have the power to recommend to the officers of the city plans consistent with the future growth and development of the city in order to secure to the city and its inhabitants proper sanitation and proper service of all public utilities and transportation facilities.

(3)

The commission shall have the power to make recommendations to any public authorities or any corporation or individuals of the city with reference to the location of any proposed buildings, structures or works.

(4)

The planning commission is hereby designated as an advisory agency as that term is used in the Subdivision Map Act, and shall have the authority to review and approve, conditionally approve or disapprove tentative tract maps and tentative parcel maps and lot line adjustments when the lot line adjustments are referred by the subdivision committee or when the action of the subdivision committee is appealed.

The commission shall have the power to perform those tasks required of it by the city council and to do those things otherwise required by law of a planning commission acting as a planning agency of a city, including undertaking the study for, preparation and recommendation of a general plan as required by law, covering a comprehensive, long-term general plan for the development of the city.

The city council is hereby designated as an appeal board as that term is used in the Subdivision Map Act, and shall hear appeals from actions of the planning commission with respect to tentative tract maps, tentative parcel maps and lot line adjustments.

Sec. 9-1-6. - Establishment of office of zoning administrator.

There is hereby created the office of zoning administrator.

Sec. 9-1-7. - Designation of zoning administrator; associate zoning administrator.

The director of community development shall act as the zoning administrator. The director shall also appoint an associate zoning administrator to act for and on behalf of the zoning administrator during his absence.

Sec. 9-1-8. - Authority of zoning administrator.

The zoning administrator shall have the authority to conduct public hearings and to make determinations regarding discretionary permit applications per section 9-1-150.
