§ 3.25.010. Purpose.

The purpose of this chapter is to provide the city with a mechanism to remedy problems associated with the anticipated development and construction of new residential structures in the city and conditions of fire safety which are reasonably anticipated to accompany such new residential development and construction.

§ 3.25.020. Definitions.

The terms used in this chapter shall have the following meanings with respect to the establishment of a procedure for a fire equipment fee:

"Developer"

means and includes every person, firm, corporation or other entity constructing or installing a dwelling unit on property located within the city.

"Dwelling unit"

means a structure, a mobile home or factory-built house designed for residential occupation. "Dwelling unit" does not include room additions to existing residential structures.

"Fire equipment"

means a fire truck and all equipment necessary to provide a functioning fire truck, including but not limited to radios, fire apparel, fire adapters, axes, fire-breathing apparatus, couplings, hoses, ladders, nozzles, saws, tools and valves.

"Issuance of building permit"

means the issuance of a permit to construct a dwelling unit.

"North La Verne"

means the adopted plan area of the hillside general plan, the common boundaries known as Wheeler Avenue to the west, Base Line Road to the south, and sphere of influence lines to the north and east.

§ 3.25.030. Determination for approval of residential development.

No building permit for the North La Verne area shall hereafter be lawfully issued with respect to residential development unless the fire equipment fee associated with residential development in North La Verne has been paid in full.

§ 3.25.040. Determination of the amount of the fire equipment fee.

The amount of the fire equipment fee, as authorized in accordance with this chapter, shall be directly paid to the city and determined at the time of issuance of building permits. All fire equipment facilities fees collected by the city shall be used solely to fund the costs associated with providing the fire equipment. The city council may from time to time, in its discretion and by resolution, fix, alter, change, amend or revise the fire equipment fee, after public hearing pursuant to Sections 65962 and 54992 of the Government Code.

§ 3.25.050. Exemptions.

The provisions of this chapter shall not apply where the residential development consists of:

A. Remodeling and renovations which do not result in creation of additional dwelling units;

B. Reconstruction of a legally established dwelling unit destroyed or damaged by fire, flood, explosion, accident, or act of God.

§ 3.25.060. California Environmental Quality Act.

A. Payment of the fire facility fee as authorized under this chapter shall constitute full and complete mitigation of adverse impact upon the city fire department, with regard to fire equipment, rising out of such residential development. The general plan and environmental documents contain other mitigation measures, such as the provision of Fire Station No. 3, which this chapter does not supersede.

B. The planning department is authorized and directed to notify each developer upon submission of plans for residential development for approval and review by the city of the applicability of this chapter with respect to the fire equipment fee.
