3.12.010 Special gas tax street improvement fund created .¶
To comply with the provisions of Article 5 of Chapter 1 of Division 1 of the Streets and Highways Code, there is hereby created in the city treasury a special fund to be known as the "Special Gas Tax Street Improvement Fund."

3.12.020 Depositions into gas tax street improvement fund .¶
All moneys received by the city from the state of California under the provisions of the Streets and Highways Code for the acquisition of real property or interests therein, or the construction, maintenance or improvement of streets or highways other than state highways shall be paid into the fund.

3.12.030 Expenditures of the gas tax street improvement fund .¶
All moneys in the fund shall be expended exclusively for the purposes authorized by, and subject to all of the provisions of, Article 5 of Chapter 1 of Division 1 of the Streets and Highways Code.

3.12.040 Capital outlay fund created .¶
Pursuant to the authority granted by Article 4 of Chapter 4, Part 1, Division 2, Title 5 of the Government Code of the state of California, a capital outlay fund is hereby established for the city.

3.12.050 Showing capital outlay fund on budget .¶
When any budget is adopted by the city council, all or part of the fund may be shown in the budget as reserves for future expenditures in subsequent years and when so shown shall be identified as to purpose, but need not be itemized.

3.12.060 Transfers to capital outlay fund .¶
At any time after the creation of the fund of the city council may transfer to the fund any unencumbered surplus funds remaining on hand at the end of a fiscal year.

3.12.080 Capital outlays and utilities defined .¶
"Capital outlays" does not include the construction, acquisition, extensions of, or additions to utilities other than utilities for the furnishing of water supply. "Utilities" does not include sewage or sanitation facilities or airports.

3.12.090 Powers, rights and duties of city council .¶
The city council shall have and does retain all the rights, powers, authorities and duties as set forth in Sections 53731 and 53732 of the Government Code.
