§ 5.40.010. Definitions.¶
The following words, terms and/or phrases shall be defined as follows:
"Authorized recycling agent"
means a municipal collection service, private refuse hauler, private recycling enterprise, private commercial entity or private nonprofit corporation or association authorized or contacted with by the city of La Cañada Flintridge to collect recyclable waste material.
"Designated collection location"
means the place where an authorized recycling agent has contracted with the city or private entity to pick up recyclable materials. This location will customarily be, but not be limited to, the curbside of a residential property or the service alley of a commercial enterprise.
"Recyclables"
means materials having an economic value in the secondary materials market. The following materials have such economic value: aluminum cans and articles, bi-metal cans, glass containers, polyethylene (PET) plastic beverage containers, newspaper, and any other materials as identified and included specifically within this chapter.
"Scavenging"
means the unauthorized collection, removal or, or possession of recyclable materials intended for collection by the city's authorized recycling agent.
"Segregated from other waste material"
shall be defined as any of the following:
The placement of recyclable materials in designated recycling containers or any other container visibly marked with the word "Recycle" or any other such word, words or wording which reasonably conveys the intent that the container is being used for the specific purpose of holding recyclable materials;
The binding of recyclable materials separately from the other waste materials;
The physical separation of recyclable materials from other waste materials.

§ 5.40.020. Ownership of recyclable materials.¶
All ownership and title rights to recyclable materials shall be vested in the city of La Cañada Flintridge once such recyclable materials have been placed at the designated collection location by the resident or commercial enterprise. The city of La Cañada Flintridge reserves the right to transfer all or a portion of its ownership and title rights to its authorized recycling agent.

§ 5.40.030. Unauthorized collection of recyclable materials.¶
No person, other than the authorized recycling agent, shall remove recyclable materials which have been segregated from other waste materials and placed at the designated collection location for the purposes of collection and recycling. Unless otherwise authorized by the city in writing, recyclable materials may not be removed by anyone other than the authorized recycling agent of the city of La Cañada Flintridge.

§ 5.40.040. Individual donation or sale of recyclables.¶
Nothing in this chapter shall limit the right of the individual person, persons, group or organizations to donate, sell or otherwise dispose of his or her own recyclable materials.

§ 5.40.050. Punishment for violation.¶
A. Any persons violating any of the provisions of this chapter not more than once in any 12 month period shall be deemed guilty of an infraction punishable by a fine not to exceed $100.
B. Any person having been found guilty of violating the provisions of this chapter who, within a period of 12 months, commits a second violation of the same provisions of this chapter, shall be guilty of an infraction punishable by a fine not to exceed $200.
C. Any person having been found guilty of violating the provisions of this chapter who, within a period of 12 months, commits a third or more violation(s) of the same provisions of this chapter, shall be guilty of an infraction punishable by a fine not to exceed $500 for each such occurrence.
